The council is one of the most important bodies for Brazilian environmental policy, as it drafts in technical and participatory meetings much of the country\u2019s environmental legislation.\r\n\r\nThe restructuring reduced the number of voting seats from 93 to 23. It also reduced the seats held by non-business civil society organizations from 11 to 4 and shortened the terms of these organizations from two years to just one, while replacing the selection process from election to random draw. The study demonstrated that the restrictions imposed by the federal government through decrees published over the course of 2020 <a href=\"https:\/\/conectas.org\/noticias\/fechamento-de-fronteiras-para-refugiados-nao-possui-base-juridica-e-sanitaria-aponta-centro-de-pesquisa-da-usp\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff;\"><strong>are not based on legal or health grounds<\/strong>.<\/span><\/a>\r\n\r\nIn response to the technical opinion, the agency declared that \u201cthere are no recommendations to segregate any border country\u201d. The decree also imposes restrictions on people from the United Kingdom, Northern Ireland and South Africa, but in these cases due to the new strains of the coronavirus.\r\n\r\nAccording to a technical statement from the Coordination Office of Epidemiological Surveillance in Ports, Airports, Borders and Customs Facilities - COVIG, in response to the Official Letter from Conectas, \u201cthe restrictions referring to travelers from or who have spent time in the past fourteen days in the United Kingdom of Great Britain and Northern Ireland, and the Republic of South Africa, were recommended to CCSMI [Crisis Committee for the Supervision and Monitoring of the Impacts of Covid-19] by Anvisa, based on the precautionary principle, due to warnings issued by the WHO regarding the identification of new variants of SARS-CoV-2 in those countries. filed a representation petition with the Federal Prosecutor\u2019s Office requesting an investigation into the discriminatory closure of land borders for refugees coming from Venezuela.\r\n\r\nDocuments produced by Anvisa (National Health Regulatory Agency) reveal that there was no guidance from the regulator to put segregated bans on the entry of people to Brazil from border countries during the restrictions imposed by the Covid-19 pandemic.\r\n\r\nThe documents were sent to Conectas in response to a<a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2020\/12\/PARECER_JURI%CC%81DICO_SANITA%CC%81RIO_FRONTEIRAS_CEPEDISA_FSP_USP.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff;\"> <strong>technical opinion<\/strong><\/span><\/a> produced by Cepedisa\u00a0(Center for Research on Health Law of the University of S\u00e3o Paulo) and addressed to the agency in December last year. The study demonstrated that the restrictions imposed by the federal government through decrees published over the course of 2020 <a href=\"https:\/\/conectas.org\/noticias\/fechamento-de-fronteiras-para-refugiados-nao-possui-base-juridica-e-sanitaria-aponta-centro-de-pesquisa-da-usp\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff;\"><strong>are not based on legal or health grounds<\/strong>.<\/span><\/a>\r\n\r\nIn response to the technical opinion, the agency declared that \u201cthere are no recommendations to segregate any border country\u201d. However, the current<span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.in.gov.br\/en\/web\/dou\/-\/portaria-n-652-de-25-de-janeiro-de-2021-300740786\" target=\"_blank\" rel=\"noopener noreferrer\"> <strong>decree issued by the federal government (no. 652, of January 25, 2021)<\/strong><\/a><\/span> places restrictions on migrants coming from Venezuela. The decree also imposes restrictions on people from the United Kingdom, Northern Ireland and South Africa, but in these cases due to the new strains of the coronavirus.\r\n\r\nAccording to a technical statement from the Coordination Office of Epidemiological Surveillance in Ports, Airports, Borders and Customs Facilities - COVIG, in response to the Official Letter from Conectas, \u201cthe restrictions referring to travelers from or who have spent time in the past fourteen days in the United Kingdom of Great Britain and Northern Ireland, and the Republic of South Africa, were recommended to CCSMI [Crisis Committee for the Supervision and Monitoring of the Impacts of Covid-19] by Anvisa, based on the precautionary principle, due to warnings issued by the WHO regarding the identification of new variants of SARS-CoV-2 in those countries. The restrictions on foreigners from the Bolivarian Republic of Venezuela are not contained in any of the documents presented by Anvisa to support the decision-making process of the aforementioned Committee.\u201d\r\n<ul>\r\n \t<li><a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2021\/02\/Oficio_1295531.html\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Read the official letter sent by Anvisa here<\/strong><\/a><\/li>\r\n<\/ul>\r\nThe agency also released a <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/conectas.org\/wp-content\/uploads\/2021\/02\/SEI_ANVISA-1263508-Nota-Te%CC%81cnica-249-2020-GIMTV.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>technical report<\/strong><\/a><\/span> sent to the ministries with guidance on the entry of migrants into the country during the pandemic as determined by <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2020\/lei\/L13979compilado.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff;\"><strong>Law No. 13,979\/2020<\/strong>.\u00a0<\/span><\/a>\r\n\r\nIn addition to Anvisa, Conectas also submitted its letter to the ministries of Justice, Health and Infrastructure, the Office of the Chief of Staff and other government bodies responsible for the restriction.\r\n\r\nIn response to Conectas, the Ministry of Justice and Public Security stated that \u201cthere is no doubt that the inter-ministerial decree in question has legal backing. Between 2009 and 2016, law enforcement officers were responsible for 22,000 deaths. In 2018 alone, 6,200 people were killed by the police \u2013 one person every 85 minutes. The profile of the victims also reveals violence directed at black youth: 99.3% are men, 77.9% are young and 75.4% are black.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">To address this situation and demand a new model of law enforcement, <\/span><b>several organizations, social movements and group on the front line of the resistance against police lethality came together to draft ADPF Case (Allegation of Violation of a Fundamental Precept) No. 635, which later came to be known as the ADPF Favelas Case.\u00a0\u00a0\u00a0<\/b>\r\n\r\n<span style=\"font-weight: 400;\">The case was filed by the Public Defender\u2019s Office of the State of Rio de Janeiro and the organizations Educafro, Justi\u00e7a Global, Redes da Mar\u00e9, Conectas, Movimento Negro Unificado, Iser, Iniciativa Direito \u00e0 Mem\u00f3ria e Justi\u00e7a Racial, Coletivo Papo Reto, Coletivo Fala Akari, Rede de Comunidades e Movimento contra a Viol\u00eancia, M\u00e3es de Manguinhos \u2013 organizations later admitted as amici curiae \u2013 and also Observat\u00f3rio de Favelas, GENI\/UFF, Mar\u00e9 Vive, Instituto Marielle Franco, the National Human Rights Council and CESeC.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The case was submitted to the Supreme Court in November 2019 by the Brazilian Socialist Party (PSB). The petition <\/span><b>challenges two state government decrees that regulate Rio de Janeiro\u2019s security policy and calls for recognition of the serious human rights violations <\/b><span style=\"font-weight: 400;\">committed by the police forces in the state\u2019s favelas, as well as the implementation of concrete measures to reduce lethality and guarantee justice for the victims.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In their contribution as amicus curiae, Conectas and Redes da Mar\u00e9 presented analysis and decisions that confirm the state of affairs described in the ADPF case, such as the reports of the UN Special Rapporteur on Extrajudicial, Summary or Arbitrary Executions and the sentence from the Inter-American Court of Human Rights in the Nova Bras\u00edlia Favela case, from 2017. In this specific case, the Inter-American Court drew attention to the impact that the lack of adequate investigation of crimes committed by police officers has had on the guarantee of justice and the protection of human rights in Brazil.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">As far as Conectas and Redes da Mar\u00e9 are concerned, the reports of people directly affected by police violence, the data and the independent analysis produced by international bodies leave no doubt that there is in Brazil, and in particular in Rio de Janeiro, a policy of genocide against the black population through the direct action and omission of the State.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In 2020, on account of the Covid-19 pandemic, the organizations that participated in the case as amicus curiae requested the temporary suspension of all non-essential police operations.\u00a0<\/span><b>In a historic ruling, the rapporteur of the case, Justice<\/b> <b>Edson Fachin, accepted the request and this decision was later confirmed by the full bench of the court<\/b><span style=\"font-weight: 400;\"> \u2013 the only dissenting vote was from Justice Alexandre de Moraes. Fachin also temporarily banned police from firing guns from armored helicopters and from conducting operations around schools and hospitals.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">No date has been set for the judgment of the merit of the ADPF case, but the organizations believe that the decisions taken so far already represent important progress in protecting lives. The profile of the victims also reveals violence directed at black youth: 99.3% are men, 77.9% are young and 75.4% are black.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">To address this situation and demand a new model of law enforcement, <\/span><b>several organizations, social movements and group on the front line of the resistance against police lethality came together to draft ADPF Case (Allegation of Violation of a Fundamental Precept) No. 635, which later came to be known as the ADPF Favelas Case.\u00a0\u00a0\u00a0<\/b>\r\n\r\n<span style=\"font-weight: 400;\">The case was filed by the Public Defender\u2019s Office of the State of Rio de Janeiro and the organizations Educafro, Justi\u00e7a Global, Redes da Mar\u00e9, Conectas, Movimento Negro Unificado, Iser, Iniciativa Direito \u00e0 Mem\u00f3ria e Justi\u00e7a Racial, Coletivo Papo Reto, Coletivo Fala Akari, Rede de Comunidades e Movimento contra a Viol\u00eancia, M\u00e3es de Manguinhos \u2013 organizations later admitted as amici curiae \u2013 and also Observat\u00f3rio de Favelas, GENI\/UFF, Mar\u00e9 Vive, Instituto Marielle Franco, the National Human Rights Council and CESeC.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The case was submitted to the Supreme Court in November 2019 by the Brazilian Socialist Party (PSB). The petition <\/span><b>challenges two state government decrees that regulate Rio de Janeiro\u2019s security policy and calls for recognition of the serious human rights violations <\/b><span style=\"font-weight: 400;\">committed by the police forces in the state\u2019s favelas, as well as the implementation of concrete measures to reduce lethality and guarantee justice for the victims.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In their contribution as amicus curiae, Conectas and Redes da Mar\u00e9 presented analysis and decisions that confirm the state of affairs described in the ADPF case, such as the reports of the UN Special Rapporteur on Extrajudicial, Summary or Arbitrary Executions and the sentence from the Inter-American Court of Human Rights in the Nova Bras\u00edlia Favela case, from 2017. In this specific case, the Inter-American Court drew attention to the impact that the lack of adequate investigation of crimes committed by police officers has had on the guarantee of justice and the protection of human rights in Brazil.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">As far as Conectas and Redes da Mar\u00e9 are concerned, the reports of people directly affected by police violence, the data and the independent analysis produced by international bodies leave no doubt that there is in Brazil, and in particular in Rio de Janeiro, a policy of genocide against the black population through the direct action and omission of the State.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In 2020, on account of the Covid-19 pandemic, the organizations that participated in the case as amicus curiae requested the temporary suspension of all non-essential police operations.\u00a0<\/span><b>In a historic ruling, the rapporteur of the case, Justice<\/b> <b>Edson Fachin, accepted the request and this decision was later confirmed by the full bench of the court<\/b><span style=\"font-weight: 400;\"> \u2013 the only dissenting vote was from Justice Alexandre de Moraes. The justice noted that, according to Law 10,792\/2003, which amended the National Prison Law (Law 7,210\/1984) and the Code of Criminal Procedure, the control of entry into prisons must be performed using electronic equipment such as metal detectors, body scanners, hand-held detectors and X-ray machines. The absence of this equipment, claimed the justice, does not justify the use of intimate searches.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The organizations Conectas Human Rights, ITTC (Land, Labor and Citizenship Institute) and IDDD (Defense of the Right to a Defense Institute) are participating in the judgment as amici curiae&nbsp;(friends of the court) to highlight the illegality of the procedure. The organizations form the Criminal Justice Network, a group of nine organizations that are working to promote a justice system that is based on human rights.
