{"id":7459,"date":"2016-12-19T00:00:00","date_gmt":"2016-12-19T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org\/wp\/?post_type=noticia&#038;p=7459"},"modified":"2021-04-16T12:55:21","modified_gmt":"2021-04-16T12:55:21","slug":"national-justice-council-investigate-judge-ivan-sartori","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/national-justice-council-investigate-judge-ivan-sartori\/","title":"National Justice Council to investigate Judge Ivan Sartori","content":"<div class=\"tts_content_wrapper_1\" ><p>The CNJ (National Justice Council) decided on Friday, December 16, to open an investigation into Appellate Judge Ivan Sartori, of the S\u00e3o Paulo State Court of Appeals, for his conduct in the judgement of an appeal against the Carandiru massacre case. In his vote, given in September, Judge Sartori called for the annulment of the trial court jury and the acquittal of the 74 military police officers convicted of the murder of 111 prisoners in the Carandiru Detention Center in 1992.<\/p>\n<ul>\n<li><strong>Click\u00a0<a href=\"https:\/\/conectas.org\/arquivos\/editor\/files\/Decisa%CC%83o%20CNJ%20Sartori.pdf\">here<\/a>\u00a0to read the decision of the CNJ in full.<\/strong><\/li>\n<\/ul>\n<p>At the time, the judge said \u201cthere was no massacre, it was legitimate self-defense\u201d. Afterwards, he used the social networks to insinuate that the negative repercussions of his decision were related to the financing of the press and human rights organizations by organized crime.<\/p>\n<p>In October, more than 60 jurists, journalists and non-governmental organizations \u2013 among them Conectas \u2013\u00a0<a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/46893-injustice-system\">sent a disciplinary complaint<\/a>\u00a0to the CNJ calling for Sartori\u2019s temporary suspension and an investigation into abuse, breach of decorum, lack of isonomy and impartiality in the handling of the case.<\/p>\n<p>In the decision signed on Friday, Internal Affairs Commissioner Jo\u00e3o Ot\u00e1vio de Noronha denied the request for the judge\u2019s suspension, but agreed to open investigations \u201cin order to determine whether there was any violation of functional duties\u201d by Sartori. The appellate judge has 15 days to respond.<\/p>\n<p>If it is concluded that there were indeed irregularities in his handling of the case, the CNJ could initiate disciplinary administrative proceedings against Sartori, which would be judged by all the members of the Council. If he is found guilty, the judge may be forced into retirement<\/p>\n<p>\u201cThe decision of the CNJ to investigate the case is an important recognition that the Judiciary is aware of the irresponsible and fanciful positions of Ivan Sartori,\u201d said Rafael Cust\u00f3dio, coordinator of the Justice program at Conectas. \u201cThe appellate judge offended the families of the victims and he offended Brazilian history, which certainly recognizes the Carandiru massacre as one of its darkest and most shameful chapters,\u201d he added.<\/p>\n<p>Featuring among the other organizations, besides Conectas, that\u00a0<a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/46893-injustice-system\">signed the disciplinary complaint<\/a>\u00a0are the Brazilian Public Security Forum, Justi\u00e7a Global, the Gaspar Garcia Human Rights Center, the Justice and Peace Commission and the Vladimir\u00a0Herzog Institute. The document was also endorsed by public figures, jurists and academics such as Jos\u00e9 Luiz Del Rojo, Jos\u00e9 Carlos Dias, Maria Stella Gregori, Jos\u00e9 Gregori, Luiz Carlos Bresser Pereira and Paulo S\u00e9rgio Pinheiro.<\/p>\n<ul>\n<li><strong>Click\u00a0<a
