{"id":6313,"date":"2013-04-03T00:00:00","date_gmt":"2013-04-03T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org.inf.br\/wp\/noticias\/combating-torture-3\/"},"modified":"2021-05-06T17:42:40","modified_gmt":"2021-05-06T17:42:40","slug":"combating-torture-3","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/combating-torture-3\/","title":"Combating torture","content":"<div class=\"tts_content_wrapper_1\" ><h2>Four years after the implementation of the National Mechanism to Combat Torture, the state of S\u00e3o Paulo has still not passed a law to create its own state-level mechanism.<\/h2>\n<p>The criticism was made this Monday, September 18, by a group of civil society organizations and public bodies during the 36th session of the UN Human Rights Council.<\/p>\n<p>In 2007, Brazil ratified the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and six years later it passed Federal Law 12,847\/13 that created the national mechanism and recommended the creation of state-level mechanisms.<\/p>\n<p><a href=\"https:\/\/conectas.org\/arquivos\/editor\/files\/2017-09-18%20-%20Oral%20Statement%2036%C2%AA%20Sessa%CC%83o%20CDH_vFinal%20-%20sug%20Paulo(1).pdf\">&gt;&gt;<\/a><strong><a href=\"https:\/\/conectas.org\/arquivos\/editor\/files\/2017-09-18%20-%20Oral%20Statement%2036%C2%AA%20Sessa%CC%83o%20CDH_vFinal%20-%20sug%20Paulo(1).pdf\">\u00a0<\/a><u><a href=\"https:\/\/conectas.org\/arquivos\/editor\/files\/2017-09-18%20-%20Oral%20Statement%2036%C2%AA%20Sessa%CC%83o%20CDH_vFinal%20-%20sug%20Paulo(1).pdf\">Read the statement in full<\/a><\/u><\/strong><\/p>\n<p>Despite having a third of Brazil\u2019s prison population, the state of S\u00e3o Paulo has still not acted on the recommendation. In 2016, civil society again pressured the administration of Governor Geraldo Alckmin to fulfill its obligation and draft this legislation. As a result of its failure to do so, the group of organizations have asked the UN Human Rights Council to keep abreast of the situation and publicly address the issue.<\/p>\n<p>\u201cGovernor Alckmin has refused to take responsibility for making a key institutional change to combat and prevent torture in the state. It\u2019s worth noting that there are more than 200,000 people in prison in S\u00e3o Paulo, nearly a third of the entire country\u2019s prison population,\u201d said Rafael Cust\u00f3dio, coordinator of Institutional Violence at Conectas. \u201cThe implementation of the mechanism would strengthen social control over detention facilities, helping guarantee fundamental rights,\u201d he added.<\/p>\n<p>The response of the state of S\u00e3o Paulo was given by the Brazilian Ambassador to the UN in Geneva, Maria de Nazar\u00e9 Farani, who reiterated the country\u2019s full commitment to effectively preventing and combating torture. \u201cConsulted about the matter in question, the S\u00e3o Paulo State Justice and Citizenship Department has informed that it adheres to and fully supports the national policy to combat torture.
