{"id":6052,"date":"2017-04-13T00:00:00","date_gmt":"2017-04-13T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org.inf.br\/wp\/noticias\/historic-recognition\/"},"modified":"2021-04-13T17:35:05","modified_gmt":"2021-04-13T17:35:05","slug":"historic-recognition","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/historic-recognition\/","title":"Historic recognition","content":"<div class=\"tts_content_wrapper_1\" ><p>The Presidency of the Republic has taken an important step in recognizing a right of women who, due to their social vulnerability, end up running errands for Brazil\u2019s big drug trafficking networks.<\/p>\n<p>According to a <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_Ato2015-2018\/2017\/Dsn\/Dsn14454.htm\">decree<\/a> published this Thursday, April 13, women convicted of drug trafficking will be pardoned on Mother\u2019s Day.<\/p>\n<p>As a result of this unprecedented decision, women who are in prison for this crime \u2013 provided they are first-time offenders, have no prior criminal record and do not belong to organized crime, a category known as small-time trafficking or \u201cprivileged trafficking\u201d \u2013 and who have already served one-sixth of their sentences will be granted clemency.<\/p>\n<p>Brazil\u2019s drug law, which leaves it up to the judge to decide whether someone in possession of drugs is a user or a dealer \u2013 based on what the police and prosecutors say, is primarily responsible for the 600% increase (according to data from the Ministry of Justice) in the number of women imprisoned for drug crimes since the law\u2019s approval in 2006.<\/p>\n<p>\u201cIt makes no sense to keep people in prison who have not committed violent crimes and who played a very minor role in the drug trafficking chain,\u201d said Marcos Fuchs, associate director of Conectas. \u201cThey are mothers, grandmothers, pregnant women and other poor women for whom the impact of a prison sentence is far more serious and harmful to society than the actual crime they committed,\u201d he said.<\/p>\n<p>The pardon will extend to mothers, grandmothers, elderly women over 60, young women under 21, disabled women and those convicted of other non-violent crimes.<\/p>\n<p><strong>Supreme Court Decision<\/strong><\/p>\n<p>Civil society organizations have campaigned for years for Brazil to recognize pardons and commutations \u2013 replacement of sentences with less severe punishments \u2013 as a right of women convicted for drug trafficking. This recognition is also supported by the government\u2019s own CNPCP (National Criminal and Prison Policy Council), which submitted to the Executive Branch a proposal for pardons that extended to female prisoners.<\/p>\n<p>The pardon is only possible thanks to a July 2016 ruling by the Supreme Court, which decided by eight votes to three that <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/45741-supreme-court-small-time-trafficking-is-not-a-%E2%80%9Cheinous-crime%E2%80%9D\">small-time trafficking is not a \u201cheinous crime\u201d<\/a>.<\/p>\n<p>Prior to this ruling, the legal classification of all drug trafficking offenses as \u201cheinous crimes\u201d prevented the government from issuing pardons on commemorative dates or commuting sentences. It also meant they were non-bailable offenses.<\/p>\n<p><strong>What is a pardon?<\/strong><\/p>\n<p>Provided for in the <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/L7210.htm\">Prison Sentence Enforcement Law<\/a> and in the <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/decreto-lei\/Del2848compilado.htm\">Criminal Code<\/a>, a presidential pardon is a form of clemency for prisoners who meet certain criteria.
