{"id":5643,"date":"2016-08-10T00:00:00","date_gmt":"2016-08-10T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org.inf.br\/wp\/noticias\/end-of-the-deadlock\/"},"modified":"2021-03-25T20:58:12","modified_gmt":"2021-03-25T20:58:12","slug":"end-of-the-deadlock","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/end-of-the-deadlock\/","title":"End of the deadlock","content":"<div class=\"tts_content_wrapper_1\" ><p>The Higher Council of the MP-SP (S\u00e3o Paulo Public Prosecutor\u2019s Office) ruled at a meeting held this Tuesday, August 9, that the S\u00e3o Paulo State Attorney General, Gianpaolo Smanio, will decide which body of the Public Prosecutor\u2019s Office will be responsible for overseeing police action at protests.<\/p>\n<p>The decision was unanimous and based on a <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/45757-who-polices-the-police\"><u>representation<\/u><\/a> submitted in February by six human rights organizations that, given the lack of investigation into abuses committed at demonstrations, questioned the effectiveness of the MP-SP\u2019s oversight of the police &#8211; a duty <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/Constituicao\/Constituicao.htm\"><u>established by the Constitution<\/u><\/a> and by state law.<\/p>\n<p>The representation was submitted by Conectas, <a href=\"http:\/\/artigo19.org\/\"><u>Article 19<\/u><\/a>, <a href=\"http:\/\/www.ibccrim.org.br\/\"><u>IBCCrim<\/u><\/a> (Brazilian Criminal Sciences Institute), the <a href=\"http:\/\/www.sasp.org.br\/institucional\/comissoes.html\"><u>Human Rights Commission of the S\u00e3o Paulo Union of Lawyers<\/u><\/a> and the <a href=\"http:\/\/www.defensoria.sp.gov.br\/dpesp\/Default.aspx?idPagina=3040\"><u>Human Rights Center and Ombuds Office of the S\u00e3o Paulo Public Defender\u2019s Office<\/u><\/a>.<\/p>\n<p>First received in February by the then S\u00e3o Paulo State Attorney General, Marcio Elias Rosa, the document was forwarded to Gecep (Police Activity Special External Oversight Group), which determined that it should be shelved. Its argument was that another similar case was under analysis by the Human Rights Prosecutor\u2019s Office &#8211; which, in turn, had already claimed that it only had a limited role in this matter since it was not responsible for the external oversight of police activity.<\/p>\n<p>The decision of the Higher Council of the MP-SP comes in response to an <a href=\"\/arquivos\/editor\/files\/2016_05_05_recurso%20Representac%cc%a7a%cc%83o_MP_Manifestac%cc%a7o%cc%83es_2016_final%20(1)(1).pdf\"><u>appeal<\/u><\/a> filed by the signatory organizations of the representation questioning the outcome given by Gecep. The organizations also submitted a <u><a href=\"\/arquivos\/editor\/files\/Memoriais%20Conselho%20Superior.pdf\">memorial<\/a><\/u>\u00a0to revive the case and to reinforce the arguments presented at
