{"id":5463,"date":"2016-04-12T00:00:00","date_gmt":"2016-04-12T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org.inf.br\/wp\/noticias\/ruling-postponed\/"},"modified":"2021-03-23T19:43:56","modified_gmt":"2021-03-23T19:43:56","slug":"ruling-postponed","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/ruling-postponed\/","title":"Ruling postponed","content":"<div class=\"tts_content_wrapper_1\" ><p>Maur\u00edcio Fiorito, the reporting judge in the <a href=\"https:\/\/conectas.org\/en\/news\/43618-limits-on-repression\"><u>case on the regulation of the use of force by police at protests<\/u><\/a> that is being heard in the S\u00e3o Paulo State Court, today, April 12, requested an adjournment of the case. He said that following the statements made during the session by representatives of the Public Defender\u2019s Office, Article 19 and Conectas Human Rights, he would have to \u201creflect more on the case\u201d. \u201cThe oral statements were so well presented that I feel an obligation to improve my vote,\u201d he said.<\/p>\n<p>The judge also asked for the <a href=\"http:\/\/www.protestonaoecrime.minhasampa.org.br\/\"><u>public petition<\/u><\/a> organized by the <em>Minha Sampa<\/em> network and delivered to the court by the Public Defender\u2019s Office to be digitized and attached to the case. The petition received more than 12,000 signatures in just five days.<\/p>\n<ul>\n<li><strong>Click <a href=\"http:\/\/www.protestonaoecrime.minhasampa.org.br\/\"><u>here<\/u><\/a> to sign the petition.<\/strong><\/li>\n<\/ul>\n<p>Fioreto is a member of the 3rd Public Law Chamber of the S\u00e3o Paulo State Court, together with the judges Camargo Pereira and Antonio Carlos Malheiros. They will decide whether or not to uphold a <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/26476-historic-decision-limits-on-the-military-police\"><u>trial court injunction<\/u><\/a> that restricts the use of less-lethal weapons by the military police at protests and that requires the police to draft a regulation on the use of force in these situations.<\/p>\n<p>The case was filed in 2014 by the S\u00e3o Paulo Public Defender\u2019s Office based on <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/reports-suggest-that-police-encircled-demonstrators-marching-on-june-13-in-sao-paulo\"><u>abuses committed by the military police during the mass protests in June 2013<\/u><\/a>. In October of the same year, Judge Valentino Aparecido de Andrade, of the 10th Public Finance Court,<a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/26476-historic-decision-limits-on-the-military-police\"> <u>issued an injunction<\/u><\/a> that was overturned just days afterwards by Appellate Judge Ronaldo Andrade.<\/p>\n<p><strong>Click <a href=\"https:\/\/conectas.org\/arquivos\/editor\/files\/Liminar%20ACP.pdf\"><u>here<\/u><\/a> to read the trial court injunction.<\/strong><\/p>\n<p><strong>Click <a href=\"https:\/\/conectas.org\/arquivos\/editor\/files\/Decisao%20TJSP%20Liminar%20Protestos.pdf\"><u>here<\/u><\/a> to read the ruling that suspended the injunction just days afterwards.<\/strong><\/p>\n<p><img decoding=\"async\" style=\"width: 400px; height: 267px; float: right;\" title=\"Jo\u00e3o Paulo Brito\/ Conectas\" src=\"\/arquivos\/editor\/images\/Julgamento%20ACP-2.jpg\" alt=\"\" longdesc=\"Public prosecutor Cristina Caboclo said the injunction is \u201creasonable\u201d and should be upheld by the court\" \/>During the proceedings, the organizations Conectas Human Rights and Article 19 were admitted as amicus curiae \u2013 a legal instrument that allows the presentation of independent opinions on the case being heard.<\/p>\n<p><strong>Statements<\/strong><\/p>\n<p>The first to present arguments to the judges was Mirna Cianci, the S\u00e3o Paulo State Public Finance Prosecutor who filed the case to suspend the trial court injunction. Without addressing the topic of regulating the use of force by the police, Cianci claimed that \u201cthere are no absolute rights\u201d and that unauthorized demonstrations can pose a risk to people\u2019s lives, for example when they need to get to a hospital. At the end of her statement, she asked the judges to uphold the suspension of the injunction.<\/p>\n<p>Cianci was followed by Daniela Skromov, the coordinator of the Citizenship and Human Rights Center of the S\u00e3o Paulo Public Defender\u2019s Office. Skromov began her statement by emphasizing the \u201chistoric\u201d and \u201cunprecedented\u201d nature of the case and stressing that police violence is not the result of isolated excesses, but rather the lack of a \u201chumanistic, rational and adequate protocol to the Constitution\u201d.<\/p>\n<p>This, she said, explains <a href=\"https:\/\/conectas.org\/pt\/noticia\/42600-nexo-o-comportamento-da-policia-diante-dos-protestos\"><u>the discretion exercised by the military police at demonstrations with different agendas<\/u><\/a>. \u201cSometimes they blind journalists, other times they send the Security Secretary in person to Avenida Paulista to talk to 26 people who had been blocking traffic for countless hours,\u201d said Skromov, referring to a protest in support of the impeachment of President Dilma Rousseff that obstructed the street for 38 hours in March.<\/p>\n<p>She concluded by stating that \u201cpublic security is not a carte blanche for a policy of bullets, beatings and tear gas\u201d and that a protocol on the use of force would benefit police officers, citizens and the Judiciary itself in controlling the legality of demonstrations.<\/p>\n<p>After the public defender, the judges heard statements by Camila Marques, a lawyer from Article 19, and Rafael Cust\u00f3dio, a lawyer and coordinator of the Justice program at Conectas.<\/p>\n<p><strong>Click <u>here<\/u> to read the amicus curiae submitted by Conectas.<\/strong><\/p>\n<p><strong>Click <u>here<\/u> to read the amicus curiae submitted by Article 19.<\/strong><\/p>\n<p><img decoding=\"async\" style=\"width: 401px; height: 267px;\" title=\"Jo\u00e3o Paulo Brito\/ Conectas\" src=\"\/arquivos\/editor\/images\/Julgamento%20ACP-3.jpg\" alt=\"\" longdesc=\"No date has yet been set to resume the judgement of the case\" \/><br \/>\nThe representative of Article 19 based her arguments on the organization\u2019s analysis of more than 1,500 protests and she stated that police violence is not isolated, but \u201csystematic\u201d and \u201cpersistent\u201d. \u201cA report published by the Inter-American Commission on Human Rights last month noted that the police have been acting in a manner incompatible with international standards and that the use of force should always satisfy the principles of legality, with absolute responsibility,\u201d said Marques.<\/p>\n<p>She also mentioned the cases of the journalist S\u00e9rgio Silva, who was blinded in one eye by a rubber bullet, and the secondary school students, <a href=\"http:\/\/artigo19.org\/blog\/2016\/04\/05\/audiencia-na-cidh-ira-denunciar-brasil-por-violencia-contra-secundaristas\/\"><u>who last week denounced abuses by the military police to the IACHR<\/u><\/a> (Inter-American Commission on Human Rights of the OAS). \u201cViolations continue to occur at demonstrations, which is why today it is so important and necessary, given the inaction of the S\u00e3o Paulo state government, for the State Court to assume this commitment,\u201d she concluded.<\/p>\n<p>Rafael Cust\u00f3dio, meanwhile, refuted the state prosecutor by explaining that the alternative between the right to assembly and the maintenance of public order is false dichotomy, and he mentioned two UN rules that regulate the use of force by the police: the <a href=\"http:\/\/www.mpsp.mp.br\/portal\/page\/portal\/cao_civel\/cadeias\/doutrina\/C%C3%B3digo%20de%20Conduta%20Funcion%C3%A1rios%20Aplica%C3%A7%C3%A3o%20da%20Lei.pdf\"><u>Code of Conduct for Law Enforcement Officials<\/u><\/a>, of 1979, and the <a href=\"http:\/\/pfdc.pgr.mpf.mp.br\/atuacao-e-conteudos-de-apoio\/legislacao\/segurancapublica\/principios_basicos_arma_fogo_funcionarios_1990.pdf\"><u>Basic Principles on the Use of Force and Firearms by Law Enforcement Officials<\/u><\/a>, of 1990.<\/p>\n<p>\u201cIt is important for us to draw on these two legal frameworks in order to disprove the widely held opinion that this is an obstacle to the legitimate use of force when, in fact, what we are discussing are the terms in which it is permissible at demonstrations,\u201d he said.<\/p>\n<p>Before asking for the reporting judge\u2019s vote on the case, the president Antonio Carlos Malheiros gave the floor to Cristina Caboclo, a prosecutor from the S\u00e3o Paulo Public Prosecutor\u2019s Office. She praised the case filed by the Public Defender\u2019s Office and asked the judges to uphold the trial court injunction, which she described as \u201cquite reasonable\u201d.<\/p>\n<p>After Caboclo\u2019s statement, Judge Maur\u00edcio Fiorito said that, after hearing all the arguments, he would review his vote. No date has been set to resume the judgement.<\/p>\n<p><strong>Chronology<\/strong><\/p>\n<p>08\/05\/13 \u2013 Conectas and the Citizenship and Human Rights Center of the S\u00e3o Paulo Public Defender\u2019s Office submit to the S\u00e3o Paulo State Public Security Department a series of recommendations on how the police should act in demonstrations. No response was ever given.<\/p>\n<p>04\/22\/14 \u2013 The S\u00e3o Paulo Public Defender\u2019s Office files a public civil action asking the courts to compel the state of S\u00e3o Paulo to adopt these recommendations. The case is pending in the 10th Public Finance Court.<\/p>\n<p>07\/17\/14 \u2013 Conectas <a
