The bill made rapid progress after its <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/22124-unanimous-approval\" target=\"_blank\" rel=\"noopener noreferrer\"><u>unanimous approval in the Senate<\/u><\/a>, but it has been stalled in the hands of Campos for a year. Today\u2019s hearing was also held to discuss Bill <a href=\"http:\/\/www2.camara.leg.br\/proposicoesWeb\/fichadetramitacao?idProposicao=947717\" target=\"_blank\" rel=\"noopener noreferrer\"><u>404\/2015<\/u><\/a> that extends the ban on abusive searches to detention centers for young offenders.<\/p>\n<p>Considered both humiliating and ineffective, the abusive search affects millions of prisoners\u2019 family members, who are forced to undress, squat repeatedly over a mirror and submit to an anal and vaginal inspection before visiting their relatives. A mirror was placed on the floor at the entrance to the Commission by civil society organizations to raise awareness among lawmakers of the violence of the procedure. Also participating in the session were officials and experts from the states of S\u00e3o Paulo, Rio de Janeiro, Minas Gerais, Goi\u00e1s and the Federal District.<\/p>\n<p><strong>Click <a href=\"http:\/\/www2.camara.leg.br\/atividade-legislativa\/webcamara\/arquivos\/videoArquivo?codSessao=55077#videoTitulo\" target=\"_blank\" rel=\"noopener noreferrer\"><u>here<\/u><\/a> to watch the hearing in full.<\/strong><\/p>\n<p>\u201cBrazil already has at least 11 pieces of legislation that establish complete bans on the procedure, by forbidding nudity and genital inspections. Among them are the laws approved in S\u00e3o Paulo and Rio de Janeiro,\u201d said Vivian Calderoni, a lawyer for the Justice program at Conectas, at the hearing.<\/p>\n<p>The government of S\u00e3o Paulo, the state that holds 36% of the Brazilian prison population, <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/25271-abusive-searches-banned-in-sao-paulo\" target=\"_blank\" rel=\"noopener noreferrer\"><u>signed the law<\/u><\/a> in August 2014, but it has yet to be implemented.\u00a0Data from the S\u00e3o Paulo Prison Administration Department show that more than 402,000 men and women were registered to visit the state\u2019s prison facilities in September 2013. Nearly 82% are women, adolescents and children.<\/p>\n<p>According to Calderoni, the situation will continue until there is a federal law that standardizes the rules on the matter. \u201cThe country is already in the process of abolishing the practice. It\u2019s now up to the National Congress to see this process through, by standardizing the procedure across Brazil,\u201d she added.<\/p>\n<p>\u201cFor several years now, Brazil has suffered successive international embarrassments for continuing to routinely conduct these abusive searches,\u201d said Raquel Lima, a researcher for <a href=\"http:\/\/ittc.org.br\/\" target=\"_blank\" rel=\"noopener noreferrer\"><u>ITTC<\/u><\/a> (Land, Employment and Citizenship Institute). She explained that both the UN and the OAS already equate nudity and these searches with torture.<\/p>\n<p>\u201cMay this hearing be the first step so that one day, in the very near future, we can look back and feel ashamed that we used to permit these abusive searches in the country, just like we feel now about slavery,\u201d said Lima.<\/p>\n<p><strong><a href=\"http:\/\/fimdarevistavexatoria.org.br\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" style=\"width: 250px; height: 524px; float: right;\" src=\"\/arquivos\/editor\/images\/Banner_Campanha_02_ing.jpg\" alt=\"\" longdesc=\"Click here to access the website of the campaign against abusive searches\" \/><\/a>Institutionalized violence<\/strong><\/p>\n<p>The hearing was also an opportunity for people to voice opinions against banning the searches, such as Tulio Caiban Bruno, a prosecutor from the Rio de Janeiro State Prison Council. According to him, a ban could increase the amount of contraband entering prisons. However, his argument was contradicted by the prosecutor Haroldo Caetano, from the Public Prosecutor\u2019s Office of Goi\u00e1s \u2013 a state that banned abusive searches in 2012 and did not record an increase in seizures of contraband.<\/p>\n<p>\u201cIt is not through this abusive procedure that you will improve conditions in the prison system. Quite the contrary. The prison environment is a lot calmer without the abusive searches,\u201d said Caetano.<\/p>\n<p>According to research conducted by the Criminal Justice Network using official data from the S\u00e3o Paulo Prison Administration Department, <a href=\"https:\/\/conectas.org\/arquivos\/editor\/files\/Informativo_JusticaCriminal_6_2014%20(1).pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><u>only 0.03% of visitors<\/u><\/a> who are subjected to the procedure are caught trying to enter the state\u2019s prisons with contraband items.<\/p>\n<p>As far as Caetano is concerned, the searches are not designed to guarantee security, but to target a well-defined public: poor women. Ma\u00edra Fernandes, of the Prison Monitoring Commission of the Brazilian Bar Association, reached the same conclusion. \u201cThis is a question of violence against women and the only reason it has not been resolved is because men are not subjected to it. This is what makes the problem absolutely invisible,\u201d she said.<\/p>\n<p>The bills being discussed in the Lower House of Congress propose replacing manual searches with electronic equipment, such as metal detectors and x-ray machines. According to Renato De Vitto, director of the National Prison Department of the Ministry of Justice, a ban on abusive searches must not be dependent on the purchase of this equipment.<\/p>\n<p>De Vitto also pointed out that abusive searches contribute to the disruption of social and family ties, which are essential for the reintegration of prisoners into society. \u201cMaintaining these ties is undoubtedly one of the most important ways of avoiding recidivism. It is not a favor. It is a public policy.\u201d<\/p>\n<p>The testimony of Cremilda Teixeira clearly illustrated the impact of the practice on the relationship between prisoners and their families. Teixeira visited her son in prison every week for more than a year and, each time, she was subjected to the abusive search. \u201cIt\u2019s terrible to be raped every single week. The State punishes mothers for the mistakes made by their sons,\u201d she said during the hearing. \u201cTorture is never justified in any situation. Nobody should have to pay for someone else\u2019s crime.\u201d<\/p>\n<p><strong>Progress in Congress<\/strong><\/p>\n<p>Bill <a href=\"http:\/\/www.camara.gov.br\/proposicoesWeb\/fichadetramitacao?idProposicao=619480\" target=\"_blank\" rel=\"noopener noreferrer\"><u>7.764\/2014<\/u><\/a> that is currently pending in the Lower House was drafted by former Senator Ana Rita Esg\u00e1rio and modifies the Prison Sentence Enforcement Law to ban abusive searches in the prison system. Bill <a href=\"http:\/\/www2.camara.leg.br\/proposicoesWeb\/fichadetramitacao?idProposicao=947717\" target=\"_blank\" rel=\"noopener noreferrer\"><u>404\/2015<\/u><\/a>, which was drafted by Congresswoman Luiza Erundina, adds clauses to the Sinase Law (on Brazil\u2019s youth reform centers) to ban the procedure at detention facilities for young offenders.<\/p>\n<p>Yesterday afternoon, November 18, the Constitution and Justice Commission of the Senate unanimously approved Bill <a href=\"http:\/\/www25.senado.leg.br\/web\/atividade\/materias\/-\/materia\/122224\" target=\"_blank\" rel=\"noopener noreferrer\"><u>451\/2015<\/u><\/a>, which is very similar to Bill 404 being discussed in the Lower House.
