{"id":5116,"date":"2015-08-20T00:00:00","date_gmt":"2015-08-20T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org.inf.br\/wp\/noticias\/lawmakers-against-youth-ii\/"},"modified":"2021-04-27T12:34:02","modified_gmt":"2021-04-27T12:34:02","slug":"lawmakers-against-youth-ii","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/lawmakers-against-youth-ii\/","title":"Lawmakers against youth II","content":"<div class=\"tts_content_wrapper_1\" ><p><img decoding=\"async\" style=\"width: 350px; height: 233px; float: right;\" src=\"\/arquivos\/editor\/images\/8027746354_2a8c3890b9_o_peq.jpg\" alt=\"\" \/>The Lower House of Congress approved yesterday, August 19, by 320 votes (it needed 308), the amendment to <a href=\"http:\/\/www.camara.gov.br\/proposicoesWeb\/fichadetramitacao?idProposicao=14493\" target=\"_blank\" rel=\"noopener noreferrer\"><u>Constitutional Amendment 171\/1993<\/u><\/a> that reduces the age of criminal responsibility from 18 to 16. The proposal will now proceed to the Senate. The amendment <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/40153-lawmakers-against-youth\" target=\"_blank\" rel=\"noopener noreferrer\"><u>passed in the first round<\/u><\/a> in early July following a procedural maneuver by the president of the house, Congressman Eduardo Cunha, to revive the proposal less than 24 hours after it had been rejected.<\/p>\n<p>\u201cThese 320 members of Congress are the henchmen in one of the most serious attacks against Brazilian youth,\u201d said Vivian Calderoni, a lawyer for the Justice program at Conectas. \u201cThey used, throughout the entire passage of the proposal, fallacious arguments claiming that imprisoning more people and at a younger age will have an impact on crime. This claim is definitely not supported by the facts. And even more serious, it runs counter to all the international recommendations on the topic. Yesterday, the lawmakers took Brazil in the opposite direction to the rest of the world.\u201d<\/p>\n<p><strong>Click <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/32815-lowering-the-age-of-criminal-responsibility-why-it-doesn%E2%80%99t-work\" target=\"_blank\" rel=\"noopener noreferrer\"><u>here<\/u><\/a> to read the myths and truths behind the proposal to lower the age of criminal responsibility.<\/strong><\/p>\n<p>The approved amendment establishes that adolescents older than 16 will be tried as adults only when they are involved in \u201cheinous crimes\u201d (as defined by Brazilian law), premeditated murder and bodily injury. Young people who commit these crimes currently total nearly 14% of all those in juvenile detention centers in the country, according to data from the Brazilian Public Security Forum. Data from the <a href=\"http:\/\/www.forumseguranca.org.br\/storage\/download\/\/anuario_2014_20150309.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><u>Brazilian Public Security Forum<\/u><\/a> reveal that there were 20,532 detained adolescents in Brazil in 2012. More than half (51%), according to <a href=\"http:\/\/www.ipea.gov.br\/portal\/index.php?option=com_content&amp;view=article&amp;id=25620&amp;catid=10&amp;Itemid=9\" target=\"_blank\" rel=\"noopener noreferrer\"><u>figures from Ipea<\/u><\/a> (Applied Economic Research Institute) released in June, were not attending school or working when they committed the crime. And nearly 66% of them were from extremely poor families.<\/p>\n<p>\u201cIf they were genuinely committed to reducing violence, the members of Congress would not be concerned with criminalizing black youth from the poor urban outskirts, but instead the exact opposite, approving measures to protect them since these young people are the main victims of violence,\u201d added Calderoni.<\/p>\n<p><strong>Longer sentences<\/strong><\/p>\n<p>The lawyer pointed out that the Lower House must also vote on a <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/40191-legislative-decoy\" target=\"_blank\" rel=\"noopener noreferrer\"><u>bill approved hastily by the Senate<\/u><\/a> on July 14 that increases the maximum sentence in the youth detention system from three to ten years.\u00a0Negotiated between the government and the opposition, the proposal was presented as a supposedly milder alternative to the bill to <u>l<a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/32815-lowering-the-age-of-criminal-responsibility-why-it-doesn%E2%80%99t-work\" target=\"_blank\" rel=\"noopener noreferrer\">ower the age of responsibility<\/a><\/u>.<\/p>\n<p>\u201cWe weren\u2019t fooled: lengthening sentences is just as harmful as lowering the age of criminal responsibility.
