{"id":4642,"date":"2015-03-11T00:00:00","date_gmt":"2015-03-11T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org.inf.br\/wp\/noticias\/all-up-to-the-governor\/"},"modified":"2018-01-23T21:57:04","modified_gmt":"2018-01-23T21:57:04","slug":"all-up-to-the-governor","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/all-up-to-the-governor\/","title":"All up to the governor","content":"<div class=\"tts_content_wrapper_1\" ><p>The state of Rio de Janeiro has taken an important step towards banning abusive body searches in its prisons.\u00a0This Tuesday, March 10, the Rio de Janeiro State Legislature (ALERJ) approved, by 45 votes to two, <a href=\"http:\/\/alerjln1.alerj.rj.gov.br\/scpro1519.nsf\/18c1dd68f96be3e7832566ec0018d833\/f83374fe01ce01aa83257df8006d37d3?OpenDocument\" target=\"_blank\" rel=\"noopener\"><u>Bill 77\/2015<\/u><\/a> that was drafted by legislators Marcelo Freixo, Jorge Picciani and Andr\u00e9 Ceciliano.<\/p>\n<p>The bill will now be sent to the state governor, Luiz Fernando Pez\u00e3o, who has two weeks to sign or veto the law.<\/p>\n<p>The text of the bill establishes that prisons are banned from subjecting visitors to invasive procedures, such as undressing, squatting repeatedly over a mirror, and anal and vaginal inspections. It also determines that other search methods be used, such as metal detectors and body scanners, or that the prisoners instead are searched after the visit.<\/p>\n<p>\u201cThe approval in Rio de Janeiro was a major step forward. The resounding vote in favor of the bill illustrates that the legislature understands that the abusive search is a humiliating practice that extends the offender\u2019s punishment to their relatives,\u201d said Vivian Calderoni, a lawyer at Conectas.<\/p>\n<p>Rio de Janeiro already has a resolution (<a href=\"https:\/\/db.tt\/hwvYVZKr\" target=\"_blank\" rel=\"noopener\"><u>330<\/u><\/a>), published in November 2009 by the State Prison Administration Department, that places restrictions on abusive body searches and determines, for example, the use of electronic means to perform the inspections. The state\u2019s prisons, however, have not been complying with the resolution.<\/p>\n<p>\u201cWe hope that with the approval of the law, the ban will gain more traction and be respected by prisons,\u201d added Calderoni.<\/p>\n<p>Bill 77\/15, however, does not include detention centers for young offenders. But another proposal (<a href=\"http:\/\/alerjln1.alerj.rj.gov.br\/scpro1519.nsf\/18c1dd68f96be3e7832566ec0018d833\/55ac60ff90cc0dd883257df8006cdfb8?OpenDocument&amp;ExpandSection=-1\" target=\"_blank\" rel=\"noopener\"><u>Bill 76\/2015<\/u><\/a>), also drafted by Freixo and Picciani, bans the procedure on people who visit adolescents serving sentences in these facilities, and it is currently pending in ALERJ.<\/p>\n<p><strong>Federal Bill<\/strong><\/p>\n<p>On the national level, after passing in the <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/22124-unanimous-approval\" target=\"_blank\" rel=\"noopener\"><u>Senate<\/u><\/a> in June 2014, the Lower House Commission on Human Rights and Minorities unanimously <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/26512-another-step\" target=\"_blank\" rel=\"noopener\">approved<\/a> Bill <a href=\"http:\/\/alerjln1.alerj.rj.gov.br\/scpro1519.nsf\/18c1dd68f96be3e7832566ec0018d833\/55ac60ff90cc0dd883257df8006cdfb8?OpenDocument&amp;ExpandSection=-1\" target=\"_blank\" rel=\"noopener\"><u>7764\/2014<\/u><\/a> in November that bans abusive searches from being performed in all Brazilian prisons.\u00a0The text now proceeds to two other commissions: the Public Security Commission and the Constitution and Justice Commission, before being signed into law by the president.<\/p>\n<p>\u201cThe members of Congress should follow the example set by the Rio de Janeiro and S\u00e3o Paulo state lawmakers, who have done their part,\u201d said Rafael Cust\u00f3dio, coordinator of the Justice program at Conectas. \u201cAlthough it is important for the states to mobilize to put a stop to the practice, it is crucial for the federal law to be passed, since this will allow for standardization of procedures across the country,\u201d he added.<\/p>\n<p>The abusive search is considered \u201cmistreatment\u201d by the United Nations and, depending on the circumstances, may constitute torture.
