{"id":3994,"date":"2014-07-03T00:00:00","date_gmt":"2014-07-03T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org.inf.br\/wp\/noticias\/world-cup-continues-democracy-backslides\/"},"modified":"2017-12-09T18:30:46","modified_gmt":"2017-12-09T18:30:46","slug":"world-cup-continues-democracy-backslides","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/world-cup-continues-democracy-backslides\/","title":"World Cup continues, democracy backslides","content":"<div class=\"tts_content_wrapper_1\" ><p><img decoding=\"async\" alt=\"\" src=\"\/arquivos\/editor\/images\/Direitos%20em%20peda%c3%a7os_Gustavo%20Basso_ING.jpg\" style=\"width: 680px; height: 451px; float: left;\" \/><\/p>\n<p>The action of the Military Police at a protest event staged yesterday, July 1, at Roosevelt square in S\u00e3o Paulo once again violated a long list of constitutional rights and freedoms.&nbsp;More than 300 demonstrators, who were seated and listening to a peaceful public debate on the <a href=\"http:\/\/www1.folha.uol.com.br\/poder\/2014\/06\/1476185-manifestante-preso-em-ato-em-sp-e-transferido-para-presidio-no-interior.shtml\"><u>arrest of the activists F\u00e1bio Hideki and Rafael Lusvarghi<\/u><\/a> during a protest against the World Cup on June 26, were intimidated, arbitrarily arrested and assaulted with tear gas and rubber bullets.<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cBy the time the World Cup is over, Brazil will have been dealt a very serious setback in terms of fundamental freedoms,\u201d said Lucia Nader, executive director of Conectas. \u201cWhat we saw yesterday in Roosevelt square were troops that were unprepared to deal with fundamental freedoms, but that were also heavily armed and intent on repression.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Intimidation<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Even before the event, which was widely publicized on the social networks, all the entrances to the square were blocked off by regular Military Police troops and the riot police, and officers also took it upon themselves to film the demonstrators. The mounted guard and the \u2018Rocam\u2019 motorcycle unit completed the police cordon around the square, repeating the procedure used in previous demonstrations (such as those staged on <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/23157-in-sao-paulo-world-cup-ushers-in-state-of-emergency-like-situation\"><u>7\/12\/14<\/u><\/a> and <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/reports-suggest-that-police-encircled-demonstrators-marching-on-june-13-in-sao-paulo\"><u>6\/13\/13<\/u><\/a>)<\/p>\n<p>&nbsp;<\/p>\n<p>Staff from Conectas witnessed people being searched as they approached the site of the debate. Many of them were required to show identification, even though for no apparent reason, to get through the police barricade.<\/p>\n<p>&nbsp;<\/p>\n<p>This type of enclosure, which limits and violates the freedoms of expression, movement and assembly, has already been condemned by the <a href=\"http:\/\/www.ohchr.org\/EN\/Issues\/AssemblyAssociation\/Pages\/SRFreedomAssemblyAssociationIndex.aspx\"><u>UN special rapporteur on freedom of assembly and association<\/u><\/a> and by the <a href=\"http:\/\/hudoc.echr.coe.int\/sites\/eng\/pages\/search.aspx?i=001-109581#{&quot;itemid&quot;:[&quot;001-109581&quot;]}\"><u>European Court of Human Rights<\/u><\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><img decoding=\"async\" alt=\"\" longdesc=\"To reach the event, demonstrators had to cross several police barricades\" src=\"\/arquivos\/editor\/images\/14-07-01%20-%20Midia%20Ninja%2001.jpg\" style=\"width: 350px; height: 234px; float: right;\" title=\"M\u00eddia Ninja\" \/>Sequence de violations<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>The police officers displayed all the force of their new repressive gear.&nbsp;They were wearing new body armor known as \u2018robocop\u2019 uniforms, which show no identification. According to national and international standards, the uniforms of security forces must always display clear and individual identification.<\/p>\n<p>&nbsp;<\/p>\n<p>When questioning the violation of this rule, the lawyers Daniel Biral and Silvia Daskal, from the group <a href=\"http:\/\/advogadosativistas.com\/corpo-estranho-em-praca-publica-prende-advogados\/\"><u>Advogados Ativistas<\/u><\/a> (Activist Lawyers), were violently arrested and charged with contempt.<\/p>\n<p>&nbsp;<\/p>\n<p>Click <a href=\"https:\/\/www.youtube.com\/watch?v=roaeihsDyz0\"><u>here<\/u><\/a> to watch the video that documents the moment of the arrest.<\/p>\n<p>&nbsp;<\/p>\n<p>Another four demonstrators were also detained during the event, revealing that the Military Police in S\u00e3o Paulo continue to make use of \u2018arrests for verification\u2019 &#8211; an unconstitutional power that was <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/19030-inquiries-and-indictments-whose-interests-are-served-by-this-justice-system\"><u>denounced extensively by social movements throughout 2013<\/u><\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p>At one point during the evening, a group of demonstrators rallied together to prevent the arrest of a street vendor. These developments appear even more serious when considering the heavy investment in the police ahead of the World Cup to expand its repressive capacity, with new technologies, weapons and munitions.<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cThe violations were already extremely serious before the World Cup, but every day we are shocked by a police force that knows no limits,\u201d said Lucia Nader.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>What the law says<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>The police action witnessed by Conectas expressly violates fundamental rights and guarantees protected by the&nbsp;<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/constituicao\/constituicao.htm\"><u>Federal Constitution&nbsp;of 1988<\/u><\/a>. The right to freedom of expression and the right to assembly in public places, without requiring authorization, are recognized in&nbsp;article 5, which also forbids any curtailment of the freedom to come and go.<\/p>\n<p>&nbsp;<\/p>\n<p>There is no provision in Brazilian law that permits \u201carrest for verification\u201d. The Constitution, meanwhile, is emphatic in guaranteeing individual freedoms and it prevents any law from limiting these freedoms.<\/p>\n<p>&nbsp;<\/p>\n<p>Article 5 also explicitly establishes that all detained people have the right to know the identity of those responsible for their arrest &#8211; another point violated by the Military Police at yesterday\u2019s protest, clearly evident in this <a href=\"https:\/\/www.youtube.com\/watch?v=roaeihsDyz0\"><u>video<\/u><\/a> that shows the detention of the lawyers.<\/p>\n<p>&nbsp;<\/p>\n<p>The Military Police\u2019s own <a href=\"http:\/\/www.al.sp.gov.br\/repositorio\/legislacao\/lei.complementar\/2001\/lei.complementar-893-09.03.2001.html\"><u>Disciplinary Regulations<\/u><\/a>, it is worth pointing out, classifies the absence of identification on police uniforms as a transgression.<\/p>\n<p><strong><img decoding=\"async\" alt=\"\" longdesc=\"Police used tear gas and rubber bullets to disperse demonstrators who tried to prevent the arrest of a street vendor\" src=\"\/arquivos\/editor\/images\/14-07-01%20-%20%20Barbaros%20Kayan_Midia%20Ninja%2003.jpg\" style=\"width: 350px; height: 233px; float: right;\" title=\"Barbaros Kayan\/M\u00eddia Ninja\" \/>International standards<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>The freedoms of assembly and expression are described in articles 10 and 19 of the <a href=\"https:\/\/www.google.com.br\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=1&amp;cad=rja&amp;uact=8&amp;ved=0CBwQFjAA&amp;url=http%3A%2F%2Fwww.un.org%2Fen%2Fdocuments%2Fudhr%2F&amp;ei=zr61U8-NGoqysQSV4YGwAQ&amp;usg=AFQjCNGuz0OBO9j5u30ZHPCnuznkkDiT8g&amp;sig2=-m3Lc68fP65X9gMOXr8r-w&amp;bvm=bv.70138588,d.b2U\"><u>Universal Declaration of Human Rights<\/u><\/a>, in the <a href=\"https:\/\/www.google.com.br\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=1&amp;cad=rja&amp;uact=8&amp;ved=0CB4QFjAA&amp;url=http%3A%2F%2Fwww.ohchr.org%2Fen%2Fprofessionalinterest%2Fpages%2Fccpr.aspx&amp;ei=4761U-rmOMi2sATO3IHAAw&amp;usg=AFQjCNFM-17bYQpOMjXexZ2fqU3631wfGQ&amp;sig2=5EzRWKB52QwY61xWngfoGg&amp;bvm=bv.70138588,d.cWc\"><u>International Covenant on Civil and Political Rights<\/u><\/a> and also in articles 13 and 15 of the <a href=\"https:\/\/www.google.com.br\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=1&amp;cad=rja&amp;uact=8&amp;ved=0CBwQFjAA&amp;url=http%3A%2F%2Fwww.oas.org%2Fjuridico%2Fenglish%2Ftreaties%2Fb-32.html&amp;ei=7761U6-JCfOssQTCj4HQCg&amp;usg=AFQjCNGP3KeSqfnqoj62MjRu-D-JaVq3vA&amp;sig2=w7JyzI-0aaeC5h6YvagFwg&amp;bvm=bv.70138588,d.b2U\"><u>American Convention on Human Rights<\/u><\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p>According to the Universal Declaration, \u201ceveryone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers\u201d.<\/p>\n<p>&nbsp;<\/p>\n<p>The systematic violation of these rights by the S\u00e3o Paulo police demonstrates a blatant disregard for the commitments assumed by Brazil.<\/p>\n<p>&nbsp;<\/p>\n<p>There are other international standards that regulate the role of the police at protests, such as the <a href=\"https:\/\/www.google.com.br\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=1&amp;cad=rja&amp;uact=8&amp;ved=0CBwQFjAA&amp;url=http%3A%2F%2Fwww.ohchr.org%2FEN%2FProfessionalInterest%2FPages%2FUseOfForceAndFirearms.aspx&amp;ei=EL-1U5qeLZPSsAT82IDIBQ&amp;usg=AFQjCNHZqixpmJXQMCaKJXe5YtOL0e0MMg&amp;sig2=qXYOvP9XNa27vJ6HT1z2pQ&amp;bvm=bv.70138588,d.b2U\"><u>Basic Principles on the Use of Force and Firearms by Law Enforcement Officials<\/u><\/a>, adopted by the UN in 1979, and the reports on <a href=\"https:\/\/www.google.com.br\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=1&amp;cad=rja&amp;uact=8&amp;ved=0CCEQFjAA&amp;url=http%3A%2F%2Fwww.cidh.oas.org%2Fcountryrep%2FSeguridad.eng%2FCitizenSecurity.Toc.htm&amp;ei=Ir-1U6iEPMmqsQTelYDACQ&amp;usg=AFQjCNEGaP792UhqwwO5lK3Kzm3Zt_UtKA&amp;sig2=UkPbg1_aYtpWdiD_gWkxmA&amp;bvm=bv.70138588,d.b2U\"><u>Citizen Security and Human Rights<\/u> <\/a>(2009) and the <a href=\"https:\/\/www.google.com.br\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=1&amp;cad=rja&amp;uact=8&amp;ved=0CBwQFjAA&amp;url=http%3A%2F%2Fwww.oas.org%2Fen%2Fiachr%2Fdefenders%2Fdocs%2Fpdf%2Fdefenders2011.pdf&amp;ei=Mb-1U6bkNqvksATPr4D4DQ&amp;usg=AFQjCNGIQfK9tW3HpvJ6LsPbL_EsxOmh0Q&amp;sig2=YwRFNpbYW2jLpesAiNk82Q&amp;bvm=bv.70138588,d.b2U\"><u>Situation of Human Rights Defenders in the Americas<\/u><\/a> (2012), both by the Inter-American Commission on Human Rights.<\/p>\n<p>&nbsp;<\/p>\n<p>They all prohibit the use of lethal weapons, reinforce the principles of proportionality and strict necessity, and require the clear identification of each individual police officer &#8211; another rule ignored by the S\u00e3o Paulo authorities, in spite of repeated complaints. It is important to point out that these rules must be observed regardless of the type or the size of the unrest.&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Neither is there any legal backing for the barricade set up by the police for the duration of yesterday\u2019s event.&nbsp;According to the <a href=\"http:\/\/www.ohchr.org\/EN\/Issues\/AssemblyAssociation\/Pages\/SRFreedomAssemblyAssociationIndex.aspx\"><u>UN special rapporteur on freedom of assembly and association<\/u><\/a>, these tactics similar to \u201ckettling\u201d are \u201cvery rarely justifiable\u201d. According to a decision by the <a href=\"http:\/\/hudoc.echr.coe.int\/sites\/eng\/pages\/search.aspx?i=001-109581#{&quot;itemid&quot;:[&quot;001-109581&quot;]}\"><u>European Court of Human Rights<\/u><\/a>, \u201cmeasures of crowd control should not be used by the national authorities directly or indirectly to stifle or discourage protest\u201d.
