{"id":3931,"date":"2014-06-03T00:00:00","date_gmt":"2014-06-03T00:00:00","guid":{"rendered":"http:\/\/new.conectas.org.inf.br\/wp\/noticias\/judiciary-insists-on-criminalizing-protests\/"},"modified":"2018-01-29T16:45:06","modified_gmt":"2018-01-29T16:45:06","slug":"judiciary-insists-on-criminalizing-protests","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/judiciary-insists-on-criminalizing-protests\/","title":"Judiciary insists on criminalizing protests","content":"<div class=\"tts_content_wrapper_1\" ><p>The National Justice Council (CNJ) yesterday <a href=\"\/arquivos\/editor\/files\/Decis%c3%a3o%20Indeferindo%20Limiar%20-%20CNJ%20-%20Justi%c3%a7a%20Express%20para%20Protestos.pdf\">denied <\/a>a <a href=\"https:\/\/conectas.org\/pt\/acoes\/justica\/noticia\/19034-contra-a-%E2%80%98justica-expressa%E2%80%99-nas-manifestacoes\"><u>motion for the immediate suspension<\/u><\/a> of \u2018express justice\u2019 at demonstrations, which was filed in April by Conectas and IDDD (Defense of the Rights to a Defense Institute). The decision by Judge Deborah Ciocci\u00a0may still be overturned, but it exposes the insistence of the Judiciary to criminalize the right to protest.<\/p>\n<p>The system of \u2018express justice\u2019 was created by decree by the S\u00e3o Paulo State Court (TJ\/SP) in December 2013 to hold on-the-spot trials of demonstrators arrested by the police during protests. The judges in these trials are appointed arbitrarily by the TJ\/SP, which violates the natural judge principle and poses a risk to the independence of their decisions. According to the organizations, the system is akin to a state of emergency.<\/p>\n<p>\u201cIt is regrettable that the CNJ, a body created specifically to uphold and assure fundamental principles in the Judicial Branch, has sided with the punitive obsession of the S\u00e3o Paulo court,\u201d said Rafael Cust\u00f3dio, coordinator of the Justice program at Conectas. \u201cAt a time when demonstrations have been intensifying, the decision is a sign that the State will only respond to the protests with violence and criminalization.\u00a0The Council lost its chance to prevent a serious abuse of rights.\u201d\u00a0Deborah Ciocci, the council member who denied the motion, also serves on the TJ\/SP.<\/p>\n<p>Read the <a
