{"id":22729,"date":"2020-08-25T13:07:43","date_gmt":"2020-08-25T13:07:43","guid":{"rendered":"https:\/\/conectas.org\/?post_type=noticia&#038;p=22729"},"modified":"2021-04-01T14:55:25","modified_gmt":"2021-04-01T14:55:25","slug":"supreme-court-orders-end-of-overcrowding-at-youth-detention-centers-across-the-country","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/supreme-court-orders-end-of-overcrowding-at-youth-detention-centers-across-the-country\/","title":"Supreme Court orders end of overcrowding at youth detention centers across the country","content":"<div class=\"tts_content_wrapper_1\" ><p><span style=\"font-weight: 400;\">In a unanimous decision, the Second Chamber of the Supreme Court determined, on Friday, August 21, the <\/span><b>end of overcrowding at units of the youth detention system <\/b><span style=\"font-weight: 400;\">across the country.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the rapporteur of the case, Justice Edson Fachin, the decision \u201c<\/span><b>establishes criteria and standards to be observed at all the detention centers<\/b><span style=\"font-weight: 400;\">\u201d. The decision is effective immediately.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In his vote, Fachin suggests a number of alternatives to <\/span><b>reduce overcrowding at centers<\/b><span style=\"font-weight: 400;\"> that are already operating over capacity, among them the adoption of a maximum number of people in each unit and the reassessment of cases of adolescents in custody for non-violent offenses, by scheduling hearings in the state courts.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He also cited the possibility of states <\/span><b>transferring the adolescents <\/b><span style=\"font-weight: 400;\">who exceed the maximum capacity to other facilities that have places available \u2013 provided that this other unit is not far from their family\u2019s home.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The decision was taken based on a habeas corpus originally filed by the Esp\u00edrito Santo State Public Defender\u2019s Office in 2017. Afterwards, the Public Defender\u2019s Offices of other states, such as Bahia, Cear\u00e1, Esp\u00edrito Santo, Pernambuco and Rio de Janeiro, among others, joined the petition and so the Supreme Court decision was extended to include all states.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Appearing in the case as amicus curiae \u2013 organizations accepted to contribute with technical information in court rulings \u2013 were Conectas, the Alana Institute, IBCCRIM (Brazilian Criminal Sciences Institute) and other institutions.<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li
