In a judgment concluded on Thursday, August 20, the Supreme Court declared the unconstitutionality of the production, by the Ministry of Justice, of a <\/span>file on public servants associated with the anti-fascist movement<\/b>.<\/span><\/span><\/p>\n

Nine out of the eleven justices voted that the federal government should suspend <\/b>the production of these reports. They were: Luiz Fux, Roberto Barroso, Rosa Weber, C\u00e1rmen L\u00facia, Edson Fachin, Alexandre de Moraes, Dias Toffoli, Gilmar Mendes and Ricardo Lewandowski. The only opposing vote was from Justice Marco Aur\u00e9lio. Justice Celso de Mello, who is on medical leave, did not participate.<\/span><\/span><\/p>\n

The case was filed by the political party <\/span>Rede Sustentabilidade<\/span><\/i> (Sustainability Network) and it accuses the government of <\/span>\u201cinfiltrating public bodies\u201d<\/b> for the purpose of staging <\/span>\u201cpolitical and ideological persecution\u201d<\/b>.\u00a0<\/span><\/span><\/p>\n

The existence of the report was exposed by the press in July. The secret file lists <\/span>579 federal and state public security agents<\/b> and three university professors identified as being members of the \u201canti-fascist movement\u201d.<\/span><\/span><\/p>\n

In her vote, C\u00e1rmen L\u00facia, the rapporteur of the case, defended the <\/span>suspension of all acts of government<\/b> associated with the production and sharing of information on the political activities of citizens and public servants.<\/span><\/span><\/p>\n

\u201cIt is not anyone\u2019s job to keep files on people, regardless of who they are, or to establish inquisitional procedures,\u201d said Justice L\u00facia.<\/span><\/p>\n

Gabriel Sampaio, coordinator of strategic litigation at Conectas, made an oral statement during the judgment on behalf of the organization that was accepted as an amicus curiae \u2013 institutions accepted to contribute with technical information in court rulings \u2013 in the case.<\/span><\/p>\n

\u201cWe find it alarming that, in this day and age, we are discussing the criminalization of anti-fascism,\u201d said the lawyer Gabriel Sampaio in the Supreme Court. \u201cWe are facing a real misuse of power.\u201d<\/span><\/p>\n

According to Sampaio, \u201cto date, society has yet to be presented with the justification and the potential occurrence of a criminal act\u201d that could warrant the production of the file.<\/span><\/p>\n

\u201cWe are convinced of the importance of protecting democracy and the democratic rule of law. We find it alarming that, in this day and age, we have to discuss the criminalization of anti-fascism, since we are all, including this court, the product of this anti-fascist struggle,\u201d said the lawyer.<\/span><\/p>\n
