{"id":21677,"date":"2020-06-29T19:30:55","date_gmt":"2020-06-29T19:30:55","guid":{"rendered":"https:\/\/conectas.org\/?post_type=noticia&#038;p=21677"},"modified":"2021-04-01T17:03:49","modified_gmt":"2021-04-01T17:03:49","slug":"understand-what-led-the-supreme-court-to-suspend-police-operations-in-rio-de-janeiros-favelas","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/understand-what-led-the-supreme-court-to-suspend-police-operations-in-rio-de-janeiros-favelas\/","title":"Why the Supreme Court suspend police operations in favelas of Rio de Janeiro","content":"<div class=\"tts_content_wrapper_1\" ><p><span style=\"font-weight: 400;\">Responding to a request from civil society and social movements, Supreme Court Justice Edson Fachin granted on June 5 an <\/span><a href=\"http:\/\/www.stf.jus.br\/arquivo\/cms\/noticiaNoticiaStf\/anexo\/ADPF635DECISaO5DEJUNHODE20202.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff;\"><strong><span style=\"text-decoration: underline;\">injunction<\/span><\/strong><\/span><\/a><span style=\"font-weight: 400;\"> \u2013 temporary decision \u2013\u00a0<\/span><b>banning police operations in communities of Rio de Janeiro<\/b><span style=\"font-weight: 400;\">\u00a0for the duration of the Covid-19 pandemic.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In his decision, Fachin determined that \u201cunder penalty of civil and criminal liability, police operations shall not be conducted during the Covid-19 epidemic, except in absolutely exceptional cases that must be properly justified in writing by the competent authority and notified immediately to the Public Prosecutor\u2019s Office of the state of Rio de Janeiro\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The justice also determined that, in the extraordinary cases in which these operations are conducted, the police must\u00a0<\/span><b>adopt exceptional precautions<\/b><span style=\"font-weight: 400;\">, duly identified in writing by the competent authority, to avoid putting the population, the public health services and the humanitarian aid activities at even more risk.<\/span><\/p>\n<h3><b>ADPF Favelas Case<\/b><\/h3>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/GdYCgJXGBn0\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">For the first time, NGOs, social groups and movements engaged with favelas and the mothers of victims of police operations have taken legal action against the state of Rio de Janeiro over its security policy.\u00a0The\u00a0<\/span><b><a href=\"http:\/\/portal.stf.jus.br\/processos\/detalhe.asp?incidente=5816502\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline; color: #0000ff;\">ADPF (Allegation of Violation of a Fundamental Precept)<\/span><\/a> Case No. 635<\/b><span style=\"font-weight: 400;\">, known as the \u201cADPF Favelas Case\u201d, is a lawsuit proposed by the Brazilian Socialist Party (PSB) and jointly drafted by the Public Defender\u2019s Office of the State of Rio de Janeiro and the organizations Educafro, Justi\u00e7a Global, Redes da Mar\u00e9, Conectas Direitos Humanos, Movimento Negro Unificado, Iser, IDMJR, Coletivo Papo Reto, Coletivo Fala Akari, Rede de Comunidades and Movimento contra a Viol\u00eancia, M\u00e3es de Manguinhos.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case calls for the\u00a0<\/span><b>gross violations caused by the public security policy<\/b><span style=\"font-weight: 400;\">\u00a0of the state of Rio de Janeiro to be recognized and remedied.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The judgement began on April 17, when the rapporteur, Justice Edson Fachin, gave his vote on some of the precautionary measures that had been requested.\u00a0In his vote, the justice granted some important requests:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Preservation of the crime scene;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Improving the work of the forensic bodies;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Recognition of the exceptional nature of police raids in areas near schools, day care centers, health clinics and hospitals;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Restrictions on firing guns from helicopters in police operations;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Refining the work of the Rio de Janeiro state Public Prosecutor\u2019s Office.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Following Justice Fachin\u2019s vote in April, the session was suspended after Justice Alexandre de Moraes requested an adjournment. The judgement is scheduled to resume on August 7.<\/span><\/p>\n<h3><b>A new precautionary decision<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In late May, however, a coalition of\u00a0<\/span><a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2020\/06\/Tutela-proviso%CC%81ria-incidental_versa%CC%83o-final-assinada-Assinado.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline; color: #0000ff;\"><b>organizations filed a petition<\/b><\/span><\/a><span style=\"font-weight: 400;\">\u00a0addressed to the rapporteur requesting the suspension of police actions in Rio de Janeiro during the Covid-19 pandemic.\u00a0The organizations asked the Supreme Court to order the cancellation of all police operations in favelas during the Covid-19 epidemic, except in absolutely exceptional cases that are properly justified in writing by the competent authority and notified immediately to the Public Prosecutor\u2019s Office.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Since Justice Fachin has granted the injunction, the Supreme Court will now convene to judge his decision. The virtual judgement allows the justices to publish their votes until August 4.<\/span><\/p>\n<h3><b>Action to save lives<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The judgement and the pressure from society against the police operations are occurring at a time when the country has witnessed a\u00a0<\/span><b>series of violent actions by the Military Police<\/b><span style=\"font-weight: 400;\">, including one that resulted in the death of 14-year-old Jo\u00e3o Pedro Mattos in S\u00e3o Gon\u00e7alo, in the metropolitan region of Rio de Janeiro.\u00a0According to data from the Security Observatories Network, the\u00a0<\/span><b>number of police operations grew in the state of Rio de Janeiro starting in April and now surpasses the figure from 2019<\/b><span style=\"font-weight: 400;\">, with an increase of 27.9%.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The number of killings by the police also increased: despite a decline in the early days of the epidemic, in April 2020, there was a\u00a0<\/span><b>sharp increase of 57.9% in April and of 16.7% until May 19<\/b><span style=\"font-weight: 400;\">, compared to the same period last year. The data also indicate that the police in Rio de Janeiro have used more lethal force during the pandemic than in the equivalent months of 2019, when the state had a record of 1,810 deaths caused by police intervention.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to a\u00a0<\/span><a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2020\/06\/ANEXO-I_Relat%C3%B3rio-Geni_ADPF-635-impacto-liminar.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline; color: #0000ff;\"><b>study conducted by researchers from the Fluminense Federal University<\/b><\/span><\/a><span style=\"font-weight: 400;\">, the suspension of police operations in the favelas could save more than 400 lives in one year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIn a context in which anti-racism protests have broken out around the world, it is urgent that Brazilian institutions put an end to the genocide and the violation of the rights of black people from the favelas and urban outskirts,\u201d said Gabriel Sampaio, coordinator of the program to Combat Institutional Violence at Conectas. \u201cDecisions like this are very important because they save lives,\u201d he added.<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><a
