However, Congress must then<br \/>\nanalyze and approve the orders within 120 days. If members of Congress do not vote<br \/>\nbefore the end of this deadline, the legislation loses validity.<br \/>\nIn a request made to the Supreme Court, the federal government proposed suspending<br \/>\nthe passage of provisional executive orders through Congress until the end of the<br \/>\n\u2018public calamity\u2019. The new procedure excludes the stage of debating the orders in a Joint<br \/>\nCommittee of Congress, leaving it up to each house to vote on them separately in a full<br \/>\nsession.<br \/>\nWhile acting as an amicus curiae in ADPF Case No. 663 (Allegation of Violation of a<br \/>\nFundamental Precept) in the Supreme Court, Gabriel Sampaio, a coordinator at<br \/>\nConectas Human Rights, criticized both the government\u2019s request and the fast-track<br \/>\napproval established by the Lower House and the Senate, arguing that it represents an<br \/>\n\u201cexclusion of civil society participation from the legislative process\u201d.<br \/>\n\u201cWe defend (\u2026) the legitimacy of the act of Congress to enable the exceptional<br \/>\npassage of provisional executive orders on account of the public calamity we are<br \/>\nexperiencing due to the coronavirus,\u201d said Sampaio. \u201cBut the new procedure,<br \/>\nestablished by an act of the two legislative houses, permits the passage of a<br \/>\nprovisional executive order in up to 16 days of discussion and debate (\u2026) In these 16<br \/>\ndays of its passage, just two days are allocated for the presentation of amendments.<br \/>\nPassage in the Joint Committee is replaced with a report and a legal opinion in a full<br \/>\nsession of the legislative houses,\u201d he added. \u201cBut it is during the legislative procedure<br \/>\nin the Joint Committee that the fundamental role of civil society appears.
