{"id":19296,"date":"2019-12-05T15:32:33","date_gmt":"2019-12-05T15:32:33","guid":{"rendered":"https:\/\/conectas.org\/?post_type=noticia&#038;p=19296"},"modified":"2021-04-05T13:13:19","modified_gmt":"2021-04-05T13:13:19","slug":"lower-house-of-congress-approves-anti-crime-bill-without-exemption-from-illegality-clause","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/lower-house-of-congress-approves-anti-crime-bill-without-exemption-from-illegality-clause\/","title":"Lower House of Congress approves \u201cANTI-CRIME\u201d bill without exemption from illegality clause","content":"<div class=\"tts_content_wrapper_1\" ><p>By 408 votes to nine and two abstentions, the Lower House of Congress approved on<br \/>\nthe evening of Wednesday, December 4, the so-called \u201canti-crime\u201d bill, a series of<br \/>\namendments to criminal and procedural law presented by the Minister of Justice,<br \/>\nS\u00e9rgio Moro.<\/p>\n<p>The exemption from illegality clause \u2013 one of the most controversial points of the<br \/>\noriginal bill that, in practice, would exempt police officers from liability for crimes<br \/>\ncommitted in the line of duty and that has been described by academics and organized<br \/>\ncivil society as a license to kill \u2013 was removed from the bill.<\/p>\n<p>Other serious points from the proposal originally submitted by Moro were also<br \/>\nquashed, such as the plea bargain \u2013 which would have enabled prison sentences to be<br \/>\nenforced after agreements between defendants and the Public Prosecutor\u2019s Office \u2013<br \/>\nand the legal figure of habitual offender, which would have restricted the right to a fair<br \/>\ntrial and made it harder to release people who are considered \u2013 not particularly<br \/>\nobjectively \u2013 to be \u201ccareer criminals\u201d. Imprisonment after loss of first appeal, already<br \/>\ndeemed unconstitutional by the Supreme Court, was also not approved.<\/p>\n<p>The bill approved by the full session of the Lower House of Congress, however, still<br \/>\ncontains some points considered by civil society as setbacks with regard to rights and<br \/>\nguarantees and that will have a particularly heavy impact on the prison system and on<br \/>\ncriminal procedure. These include the restrictions on bail, lengthier sentence<br \/>\nprogression and restrictions on the right of prisoners to receive visits and have contact<br \/>\nwith their families. The bill also permits immediate incarceration after a conviction<br \/>\nexceeding 15 years imprisonment by a jury trial and an increase in maximum sentences<br \/>\nfrom 30 to 40 years.<\/p>\n<p>\u201cWhat has become known as the \u2018anti-crime\u2019 package is nothing more than a set of<br \/>\namendments that restrict criminal rights and guarantees and that do nothing to<br \/>\naddress the key problems of public security and the criminal justice system,\u201d said<br \/>\nGabriel Sampaio, coordinator of the program to combat institutional violence at<br \/>\nConectas. \u201cIt is important to note that the removal of points we consider very serious,<br \/>\nsuch as the exemption from illegality clause, was the result of intense mobilization by<br \/>\ncivil society, and that the bill still has a long passage through the Senate,\u201d he added.<br \/>\nAccording to Sampaio, the approved bill will now proceed to the Senate, where a<br \/>\npackage of measures similar to the one proposed by Moro in the lower house is<\/p>\n<p>already pending. Therefore, topics such as the exemption from illegality clause need to<br \/>\nremain in the spotlight of debate.<\/p>\n<p>\u201cWe still do not know how the Senate will receive the text approved in the lower<br \/>\nhouse and how it will handle the passage of the two similar bills.
