The measure provides for <\/span><a href=\"https:\/\/conectas.org\/noticias\/contra-lei-moro-cria-deportacao-sumaria\"><b>refusing entry, repatriation and summary deportation of foreigners.\u00a0<\/b><\/a><\/p>\n<p><span style=\"font-weight: 400;\">In the action, Raquel contests the constitutionality of the ordinance. This approach has been a trademark of the Bolsonaro administration.\u201d She said.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This year, the Executive has published eight\u00a0<\/span><a href=\"https:\/\/conectas.org\/noticias\/entenda-o-vai-e-vem-da-politica-de-armas-de-bolsonaro\"><b>decrees on the policy for access and use of firearms<\/b><\/a><span style=\"font-weight: 400;\">, which has made it difficult for the Supreme Court to assess the matter.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Raquel Dodge\u2019s two-year mandate ended on Tuesday 17th. Jair Bolsonaro has already given the name of her successor, the Sub-Attorney General, Augusto Aras. The president\u2019s choice has broken a practice, in place since 2003, of selecting someone for the position from one of three names chosen by the Federal Prosecutor\u2019s Office.\u00a0<\/span><\/p>\n<p><b>Unconstitutionality of the Ordinance\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Also known as the\u00a0<\/span><b>\u201cordinance of summary deportation\u201d<\/b><span style=\"font-weight: 400;\">, ordinance 666 makes provision for the summary expulsion of migrants who are suspected of committing terrorist acts, belonging to criminal organisations or of trafficking drugs, weapons or people, among others.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The measure has been\u00a0<\/span><a href=\"https:\/\/conectas.org\/noticias\/ongs-pedem-revogacao-de-portaria-que-estabelece-deportacao-sumaria\"><b>harshly criticised<\/b><\/a><span style=\"font-weight: 400;\">\u00a0by specialists, activists and by a number of civil society organisations for being in contravention of the\u00a0<\/span><a href=\"https:\/\/conectas.org\/noticias\/saiba-a-importancia-da-nova-lei-da-migracao-para-o-brasil\"><b>New Migration Law<\/b><\/a><b>,\u00a0<\/b><span style=\"font-weight: 400;\">passed in 2017.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the text edited by Moro, suspects must produce a defence case or leave the country in up to 48 hours which goes against the provision in the Migration Law for a minimum period of 60 days for a migrant to rectify his\/her legal status.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition to contravening the Migration Law, the Attorney General\u2019s action also states that the ordinance damages constitutional principles, such as human dignity, by introducing discriminatory treatment of foreigners based on their migratory status and by denying the fundamental principle of full defence.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The evaluation is that the ordinance intrudes on normative regulatory issues that are reserved for the Constitution, because, in practice it changes important points of federal law.
