In a letter sent to The Ministry for Foreign Affairs, UN specialists and the Inter-American Commission for Human Rights (IACHR), an organ linked to the OAS (Organisation of American States), call for the S\u00e3o Paulo government to review recently created legislation that tightens the rules for holding protests in the state.<\/span><\/p>\n

The international organs\u2019 letter was sent subsequent to civil society\u2019s condemnation of the decree (64.074\/2019), issued by Jo\u00e3o D\u00f3ria Jr in January of this year.<\/span><\/p>\n

The rapporteurs, Cl\u00e9ment Voule (UN Special Rapporteur for the freedom to peaceful assembly and association), Michel Forst (UN Special Rapporteur for the situation of human rights defenders) and Edison Lanza (Special Rapporteur for the IACHR for freedom of expression) stress that Brazil has legal obligations to international commitments it has made, such as the International Covenant on Civil and Political Rights and the American Convention on Human Rights, both ratified by Brazil in 1992.<\/span><\/p>\n

\u201cWe are concerned with the fact that the implementation of this decree may serve to restrict spontaneous demonstrations and protests and therefore that it violates the right to freedom of association.\u201d\u00a0 It says in the document.<\/span><\/p>\n

Decree in SP<\/b><\/p>\n

On 19 January Governor Jo\u00e3o D\u00f3ria Jr. issued Decree 64.074\/2019 which regulates law 15.556\/2014, restricting the right to protest in S\u00e3o Paulo, in a way that civil society sees as a violation of the right to free association and assembly.<\/span><\/p>\n

The decree states the need for five days advance notification for holding a protest and criminalises the use of masks in demonstrations, among other points.<\/span><\/p>\n

At the time, the measure issued by the governor was repudiated and condemned by the organisations: Artigo 19, Conectas, Condepe (State Committee for the Rights of Human People), the S\u00e3o Paulo Public Defender\u2019s Office, IBCCRIM, ITTC and MPL (Free Fare Movement).<\/span><\/p>\n

\u201cBased on analysis of the Decree, as well as on the context in which it was issued, it is clear that it is part of a scenario of intensification and sophistication of instruments of repression, criminalisation and restriction of the right to protest.\u201d Says the urgent appeal sent to rapporteurs.<\/span><\/p>\n
