{"id":15983,"date":"2019-02-15T18:33:41","date_gmt":"2019-02-15T18:33:41","guid":{"rendered":"https:\/\/conectas.org\/?post_type=noticia&#038;p=15983"},"modified":"2019-02-26T18:22:55","modified_gmt":"2019-02-26T18:22:55","slug":"federal-government-obstructs-inspection-of-ceara-prisons","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/federal-government-obstructs-inspection-of-ceara-prisons\/","title":"Federal Government obstructs inspection of Cear\u00e1 prisons","content":"<div class=\"tts_content_wrapper_1\" ><p><span style=\"font-weight: 400;\">A statement issued on the morning of Friday 15 February by the MNPCT (National Mechanism for the Prevention and Combat of Torture) condemns the Ministry of Women, Family and Human Rights for obstructing the investigation of accusations of torture and ill-treatment in the state of Cear\u00e1.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the statement, the organ has been receiving allegations about the Cear\u00e1 prison and remand systems and also about custodial hearings, since the beginning of January. The Ministry, however, denied permission for independent experts to travel to the state.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis Mechanism was informed, in a face to face meeting, that the Ministry would not authorise expenses for a visit to the State of Cear\u00e1, unless it was in the Federal Government\u2019s interest, opposing current legislation and disregarding international precepts of the autonomy and independence of the National Mechanism for the Prevention and Combat of Torture, ratified by the Brazilian state.\u201d The note says.<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2019\/02\/Comunicado-P%C3%BAblico-n%C2%BA-01-MNPCT.pdf\"><b>Read the MNPCT note in full<\/b><\/a><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">According to Rafael Cust\u00f3dio, Representative of Conectas Human Rights on the National Committee for the Prevention and Combat of Torture, this attitude is against the law and represents an interference by the state in an independent organ.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIn prohibiting an independent organ, composed of experts, from inspecting prisons in Cear\u00e1, the federal government is demonstrating that it condones the rights violations that have been denounced by families and prisoners, in the state. We demand that the federal government back down and that the Federal Public Prosecutor take steps to clarify facts.\u201d Cust\u00f3dio said.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Organisations call on Minister to take steps<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In response to the statement, a group of civil society organisations, among them Conectas, have asked Minister Damares Alves to reconsider the decision and to urgently provide the support needed for the inspection to be carried out.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cMinister Damares Alves\u2019 refusal to provide the administrative measures needed for the Mechanism to carry out an inspection of prisons in the state of Cear\u00e1 is against the national and international legal order regarding the prevention and combat of torture and represents an entirely illegal censorship, for which it should be held accountable.\u201d<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2019\/02\/nota-e-pedido-de-provid%C3%AAncias_inspe%C3%A7%C3%A3o-Cear%C3%A1.pdf\"><b>Read the organisation\u2019s note<\/b><\/a><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The organisations also issued a request for the Federal Public Prosecutor\u2019s Office to investigate a possible infraction of the law by public workers in the Office.<\/span><\/p>\n<p><b>The MNPCT<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The MNPCT (National Mechanism for the Prevention and Combat of Torture) is part of the National System for the Prevention and Combat of Torture approved in law 12.847\/13. The organ is composed of 11 independent experts who have access to installations of denial of liberty, such as detention centres, penal institutions, psychiatric hospitals, shelters for the elderly, reform institutions and military disciplinary detention centres.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Once a violation has been corroborated, the experts write up a report with recommendations to other relevant authorities who will use these in adopting appropriate measures.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Its implementation meets an international commitment made by Brazil in 2007 with the ratification of the UN Optional Protocol to the Prevention Against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The system all includes the National Committee for the Combat of Torture, composed of 23 (twenty three) members: 11 representatives from organs of the Federal Executive and 12 from professional committees and civil society organisations.
