{"id":15868,"date":"2019-02-05T19:52:32","date_gmt":"2019-02-05T19:52:32","guid":{"rendered":"https:\/\/conectas.org\/?post_type=noticia&#038;p=15868"},"modified":"2019-02-13T17:27:33","modified_gmt":"2019-02-13T17:27:33","slug":"un-condemns-dorias-veto-of-mechanism-to-combat-torture","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/un-condemns-dorias-veto-of-mechanism-to-combat-torture\/","title":"UN condemns Doria\u2019s veto of mechanism to combat torture","content":"<div class=\"tts_content_wrapper_1\" ><p><span style=\"font-weight: 400;\">UN (United Nations) experts criticised the S\u00e3o Paulo Governor, Jo\u00e3o Doria\u2019s decision to veto the law approved in December 2018 by Alesp (S\u00e3o Paulo Legislative Assembly), that would have established a state mechanism to prevent and combat torture. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the note, the subcommittee on Prevention of Torture, the Working Group for Arbitrary Detention and the Special Rapporteur on Torture recalled that, by ratifying OPCAT (Optional Protocol to the Convention against Torture), Brazil had made a commitment to create national mechanisms for the prevention and combat of torture.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=24138&amp;LangID=E\"><b>Read the UN note in full<\/b><\/a><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(in English).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The mechanism is an organ composed of independent experts who have free access to any place of deprivation of liberty. Through inspections, members of the mechanism can request inquiries, make appraisals, produce reports, make recommendations, organise data and suggest public policies.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> \u201cThe establishment of independent torture prevention mechanisms is one of the most effective ways of protecting those in detention from ill-treatment, and is a way of guaranteeing them their right to a fair trial and the rule of law of the country. Brazil\u2019s federal government is under an international legal obligation to ensure that this happens.\u201d The UN experts claim in the note.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Federal law 12.847 that guarantees the creation of a national mechanism and proposes the creation of state mechanisms, was approved in 2013. Alagoas, Esp\u00edrito Santo, Maranh\u00e3o, Minas Gerais, Para\u00edba, Pernambuco, Sergipe, Rio de Janeiro and Rond\u00f4nia already have state mechanisms. The law vetoed by Doria has been being processed in Alespo since 2014.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cS\u00e3o Paulo is the state with the highest prison population in the country, with the third highest prison population in the world. The creation of mechanisms would allow civil society to monitor what goes on behind bars and to present recommendations to the state.\u201d Said Rafael Cust\u00f3dio, Coordinator of Institutional Violence at Conectas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cGovernor Doria\u2019s veto shows that the state has no interest in discussing such an important subject with society, nor in allowing independent monitoring. The state is lagging behind the other nine Brazilian states that already have state mechanisms and shows a disregard for national law and the international commitments made by Brazil, that call for the creation of this organ, with social participation.\u201d Cust\u00f3dio explained.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the note, UN experts urge Alesp to reverse the governor\u2019s veto.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> \u201cWe hope that Brazil will be able to continue to abide by its international obligations, reverse this decision and remain committed to the fight against torture.\u201d Said Sir Malcolm Evans, the Chairperson of the Subcommittee on Prevention of Torture
