{"id":12916,"date":"2018-06-27T15:14:26","date_gmt":"2018-06-27T15:14:26","guid":{"rendered":"https:\/\/conectas.org\/?post_type=noticia&#038;p=12916"},"modified":"2021-04-06T15:23:13","modified_gmt":"2021-04-06T15:23:13","slug":"demonstration-calls-creation-mechanism-combat-torture-sao-paulo","status":"publish","type":"noticia","link":"https:\/\/conectas.org\/en\/noticias\/demonstration-calls-creation-mechanism-combat-torture-sao-paulo\/","title":"Demonstration calls for the creation of mechanism to combat torture in S\u00e3o Paulo","content":"<div class=\"tts_content_wrapper_1\" ><p>A Public Event yesterday, 26, at the Law School of the University of S\u00e3o Paulo, called for the implementation of a mechanism for the prevention and combat of torture in the state, as outlined at the national level in 2013.<\/p>\n<p>In the presence of personalities like Jos\u00e9 Carlos Dias, Maria Rita Kehl, members of the National Commission for Truth and S\u00e9rgio Salom\u00e3o Shecaira, Professor in criminal law at USP, human rights organisations and state public defenders, they delivered a preliminary law project for the creation of the mechanism, to the candidacy of the Federal Representative Carlos Bezerra, President of the Human Rights Commission of Alesp (S\u00e3o Paulo Legislative Assembly).<\/p>\n<ul>\n<li><a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2018\/06\/2018-03-05-Minuta-PL-Comite%CC%82-e-Mecanismo-Estadual-Reunia%CC%83o_final-1.pdf\">See the civil society law proposal<\/a><\/li>\n<li><a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2018\/06\/Justificativa-PL-Mecnismo_SP_final.pdf\">See the reasoning behind the project<\/a><\/li>\n<li><a href=\"https:\/\/conectas.org\/en\/news\/opinion-end-negligence-combat-prevention-torture-sp\" target=\"_blank\" rel=\"noopener noreferrer\">Opinion: An end to negligence in the combat and prevention of torture in S\u00e3o Paulo<\/a><\/li>\n<\/ul>\n<p>S\u00e3o Paulo is currently the Brazilian state with the highest number of arrests. There are 240 thousand people in jail, 35% of the country\u2019s total prison population. To date, nine states have enacted laws for the creation of this mechanism: Alagoas, Esp\u00edrito Santo, Maranh\u00e3o, Minas Gerais, Para\u00edba, Pernambuco, Sergipe, Rio de Janeiro and Rond\u00f4nia.<\/p>\n<p>\u201cThe delay in S\u00e3o Paulo in creating a mechanism for the prevention and combat of torture is in contempt of the national law and can be seen as an act of negligence in terms of the humiliating conditions of the S\u00e3o Paulo prisons.\u201d Said Rafael Cust\u00f3dio, Coordinator of the Conectas programme for the Combat of Institutional Violence. \u201cWe have Deputy Carlos Bezerra\u2019s pledge to bring this to the table at Alesp (Legislative Assembly). We hope then that the Sao Paulo authorities will be moved into approving this important civilizing tool.\u201d He concluded.<\/p>\n<p><strong>What is the mechanism?<\/strong><\/p>\n<p>The State Mechanism for the Prevention and Combat of Torture is laid out in Law\u00a0<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2011-2014\/2013\/lei\/l12847.htm\">12.847\/13<\/a>\u00a0and in the\u00a0<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2007-2010\/2007\/decreto\/d6085.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><u>Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment<\/u><\/a>, ratified by Brazil in 2007.<\/p>\n<p>These organs are composed of independent experts, with free access to all detention centres. Members of the mechanism are able to request inquiries, carry out investigations, write reports, make recommendations, organise data and suggest public policy, based on inspections.<\/p>\n<\/div><div
