Since then, patients have faced difficulties in finding care, with some being forced to seek services in other states to undergo the procedure. Although four other municipal hospitals in the city of S\u00e3o Paulo perform legal abortions, the Cachoeirinha unit was the only one that provided care for girls, women, and pregnant individuals after the twentieth week of pregnancy, according to reports from patients and healthcare professionals.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In response to the suspension of the service, the Socialism and Liberty Party (Psol) filed a Public Civil Action (No. 1089518-19.2023.8.26.0053) with the S\u00e3o Paulo Court of Justice (TJ-SP), requesting the resumption of the procedure at Vila Nova Cachoeirinha Hospital. The reactive lawsuit aims to ensure that the judiciary order the S\u00e3o Paulo City Hall to restore the legal abortion service at this specialized facility.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Conectas, along with Anis \u2013 Institute of Bioethics, the Feminist Collective on Sexuality and Health, Catholics for Choice, and the Vivas Project, submitted an <\/span><i><span style=\"font-weight: 400;\">amicus curiae<\/span><\/i><span style=\"font-weight: 400;\"> brief in the case, aiming to contribute legal arguments supporting the need for the reinstatement of the legal abortion service. The organizations argue that the suspension of the service at Vila Nova Cachoeirinha Hospital constitutes a violation of the sexual and reproductive rights of women, girls, and pregnant individuals, particularly given that public policies to ensure legal and safe abortion are scarce in Brazil.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The organizations argue that the legal abortion service is a constitutional right linked to family planning and public health. The suspension of the service imposes obstacles that force pregnant individuals to continue pregnancies in cases that endanger their lives, result from rape, or involve anencephalic fetuses. This situation constitutes a violation of human rights and goes against the recommendations of international bodies such as the UN Committee on Economic, Social and Cultural Rights and the UN Human Rights Committee.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The litigation is still ongoing, awaiting a decision on the merits in the first instance. In January 2024, a preliminary injunction ordered the reinstatement of the legal abortion service at the hospital, but in May of the same year, the S\u00e3o Paulo Court of Justice (TJ-SP) partially upheld the City Hall&#8217;s appeal, suspending the injunction that mandated the resumption of the service, maintaining only the obligation to refer patients to other units that perform the procedure.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case is considered crucial for ensuring access to safe abortion in Brazil, as the closure of the service at this specialized hospital has forced women and girls to seek care in other locations, often without success. Furthermore, the case challenges the legality of the S\u00e3o Paulo City Hall&#8217;s administrative decision, pointing to potential violations of fundamental rights and basic principles of public law. Furthermore, the strengthening of the far right both here and overseas has fuelled the activities of anti-abortion groups on the political arena, which has led to a number of setbacks.<\/span>\r\n\r\n<b>Although the current government has revoked the&nbsp;<\/b><a href=\"https:\/\/conectas.org\/en\/noticias\/ministry-of-health-revokes-ordinance-that-complicates-legal-abortion-in-the-public-health-service\/\" target=\"_blank\" rel=\"noopener\"><b>Bolsonaro administration\u2019s ordinance <\/b><\/a><b>&nbsp;that instructed health professionals to report abortions for cases of sexual violence, to the police, steps towards guaranteeing full access to this right are hesitant, due to pressure from a predominantly conservative Congress.&nbsp;<\/b>\r\n\r\n<span style=\"font-weight: 400;\">At the end of last month, for instance, a technical note from the Ministry of Health overturned a <a href=\"https:\/\/g1.globo.com\/saude\/noticia\/2022\/06\/08\/cartilha-editada-pelo-ministerio-da-saude-diz-que-todo-aborto-e-crime-e-defende-investigacao-policial.ghtml\" target=\"_blank\" rel=\"noopener\">2022 document<\/a> that recommended a gestational period of up to 21 weeks for the procedure and also stated that \"all abortion is a crime.\" Brazilian legislation allows for legal termination to take place, without any time limit, in cases of rape, risk to the pregnant person's life, and foetal anencephaly.&nbsp;&nbsp;<\/span>\r\n\r\n<span style=\"font-weight: 400;\">However, after criticisms from lawmakers such as Senator Damares Alves, <a href=\"https:\/\/g1.globo.com\/saude\/noticia\/2024\/02\/29\/ministerio-da-saude-nota-tecnica-aborto-legal.ghtml\" target=\"_blank\" rel=\"noopener\">the note was suspended<\/a>, the justification being it had \"not gone through all the necessary spheres of the Ministry.\"&nbsp;<\/span>\r\n<h2><b>Violation of rights<\/b><\/h2>\r\n<span style=\"font-weight: 400;\">In fact, even in cases that are permitted by law, access to legal abortion is not a right that is realised in Brazil. An example of this is that <\/span><a href=\"https:\/\/oglobo.globo.com\/saude\/medicina\/aborto-legal-apenas-36-das-cidades-tem-servico-no-brasil-25456622#:~:text=RIO%20%E2%80%94%20Dos%20mais%20de%205.500,servi%C3%A7o%20no%20local%20onde%20moram.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">only 200, or 3.6%,&nbsp; of the more than 5,500 Brazilian municipalities, provide legal abortions in their healthcare networks,<\/span><\/a><span style=\"font-weight: 400;\"> which means over 37.5 million women, of reproductive age, do not have access to this service in their local area.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In addition to limited infrastructure and lack of coverage in the public healthcare system for the provision of pregnancy termination services, access to legal abortion is still socially and institutionally criminalised, imposing various barriers on women, girls, and individuals with uteruses. In 2020, <a href=\"https:\/\/g1.globo.com\/es\/espirito-santo\/noticia\/2022\/06\/27\/menina-de-10-anos-que-engravidou-apos-estupro-ha-2-anos-precisou-mudar-identidade-e-endereco.ghtm\" target=\"_blank\" rel=\"noopener\">the case of a 10-year-old girl<\/a> who was a victim of rape was emblematic. She had to travel from the interior of Esp\u00edrito Santo to Recife to undergo an abortion. Her personal information was leaked and she was confronted by anti-abortion protesters outside the hospital.&nbsp; Several other cases of victims of sexual violence have been of note in recent years. In Santa Catarina&nbsp;<\/span><a href=\"https:\/\/g1.globo.com\/sc\/santa-catarina\/noticia\/2022\/06\/20\/juiza-sc-aborto-crianca-11-anos-estuprada.ghtml\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">a judge encouraged an 11 year-old year not to have an abortion<\/span><\/a><span style=\"font-weight: 400;\">, and in&nbsp;<\/span><a href=\"https:\/\/www1.folha.uol.com.br\/cotidiano\/2023\/01\/tj-derruba-liminar-que-autorizava-aborto-em-menina-estuprada-pela-2a-vez-no-piaui.shtml\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Piau\u00ed, a 12-year old girl was denied legal abortion by the courts.<\/span><\/a>\r\n\r\n<span style=\"font-weight: 400;\">This year, more cases have come to light, for example the Hospital de Feij\u00f3, in the interior of the state of Acre,&nbsp;<\/span><a href=\"https:\/\/g1.globo.com\/ac\/acre\/noticia\/2024\/02\/03\/hospital-de-feijo-se-negar-a-fazer-aborto-em-gestante-de-feto-anencefalo-e-vira-alvo-do-mp.ghtml\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">where a pregnant woman was denied abortion<\/span><\/a><span style=\"font-weight: 400;\">&nbsp;of an anencephalic foetus and in the state of Goi\u00e1s where an \u00b4awareness campaign against abortion\u2019 is underway. The campaign was set up under a&nbsp;<\/span><a href=\"https:\/\/www.metropoles.com\/brasil\/lei-de-goias-contra-aborto-obriga-gravida-a-ouvir-coracao-do-feto\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">law that also obliges pregnant women to listen to the heartbeat of the foetus.<\/span><\/a><span style=\"font-weight: 400;\">&nbsp;In S\u00e3o Paulo,&nbsp;<\/span><a href=\"https:\/\/g1.globo.com\/sp\/sao-paulo\/noticia\/2023\/12\/24\/prefeitura-de-sp-suspende-servico-de-aborto-legal-em-hospital-referencia-no-procedimento-nao-ha-previsao-para-retomada.ghtml\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">legal abortion services have been suspended at the landmark hospital in Vila Cachoeirinha<\/span><\/a><span style=\"font-weight: 400;\"> since 2023.&nbsp; Difficulty in having IUDs fitted has also been reported at local public health centres and&nbsp;<\/span><a href=\"https:\/\/www.cartacapital.com.br\/sociedade\/juiz-da-razao-a-hospital-paulista-que-negou-diu-por-afronta-a-moralidade-crista\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">in private hospitals<\/span><\/a><span style=\"font-weight: 400;\">, which is further evidence of the violation of the constitutional right to family planning.<\/span>\r\n<h2><b>The anti-abortion movement is gaining force<\/b><\/h2>\r\n<span style=\"font-weight: 400;\">According to political scientist and lecturer at the University of Bras\u00edlia, Fl\u00e1via Biroli, <\/span><a href=\"https:\/\/gamarevista.uol.com.br\/semana\/vamos-falar-sobre-aborto\/flavia-biroli-ha-um-ataque-aberto-aos-direitos-das-mulheres-no-mundo-hoje\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">in an interview to the magazine Gama Revista<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">it is not an exaggeration to say that there is an open attack on the rights of women around the world.&nbsp;She believes conservative movements have been organising and articulating discourses to maintain the criminalisation of abortion. This means that the rise of the far-right in Brazil and around the world strengthens the increased representation of anti-abortion groups in the public discourse and policies.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">\u201cThis situation has made it possible to contest a fundamental right of women in a way that can be seen as a weakening of democracy itself.\u201d Said Biroli.&nbsp;<\/span>\r\n\r\n<b>\u201cWhen we deny the right to abortion, we deny women the fundamental right to decide on something that is central to their physical and psychological integrity, that of planning the course of their own lives.\u201d<\/b>\r\n<h2><b>Reproductive justice for all women.<\/b><\/h2>\r\n<span style=\"font-weight: 400;\">Fl\u00e1via\u00b4s words are in alignment with the conversation surrounding<\/span><b>&nbsp;reproductive justice, a term used to broaden the way sexual and reproductive rights are addressed and to directly link them to social justice<\/b><span style=\"font-weight: 400;\">. The idea is to ensure that all people are able to decide whether, how and when to have children and build a family and that they have access to resources and policies that safeguard their life projects.&nbsp;<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In an unequal country like Brazil, this also intersects with social and racial issues.&nbsp;<\/span><a href=\"https:\/\/www.generonumero.media\/reportagens\/pesquisa-nacional-aborto-2023\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The most recent National Research on Abortion (PNA)<\/span><\/a><span style=\"font-weight: 400;\">&nbsp;shows that<\/span><b>&nbsp;the highest abortion rates are found among black and indigenous people<\/b><span style=\"font-weight: 400;\">, who have low levels of education and live in peripheral areas.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">It comes as no surprise that this group has the highest mortality rate when attempting to terminate pregnancy. According to <\/span><a href=\"https:\/\/www1.folha.uol.com.br\/cotidiano\/2020\/11\/no-brasil-aborto-vitima-mais-mulheres-negras-do-que-brancas.shtml\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">data provided by IBGE<\/span><\/a><span style=\"font-weight: 400;\">, the death rate among white women as a result of abortion is 3 for every 100 thousand live births, whilst among black women this figure rises to 5. For those who have completed only elementary school, the rate is 8.5, almost double the overall average of 4.5.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The precariousness of healthcare services in these areas, the lack of sex education in schools, and limited access to contraceptive methods are some of the factors that explain this situation. Among the most critical points were the attacks on legal abortion and the timeframe thesis for the demarcation of Indigenous lands. The United Nations expert also called for the advancement of the use of body cameras by police and expressed concern about the racist nature of facial recognition services.&nbsp;<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Ashwini K.P visited Bras\u00edlia (DF), Salvador (BA), S\u00e3o Lu\u00eds (MA), S\u00e3o Paulo (SP), Florian\u00f3polis (SC) and Rio de Janeiro (RJ) from August 5 to 16. She met with state and federal government representatives, communities facing racial discrimination, as well as more than 120 representatives of civil society.&nbsp;<\/span>\r\n<h2><b>Restrictions on legal abortion<\/b><\/h2>\r\n<span style=\"font-weight: 400;\">The restricted access to legal abortion in Brazil, especially for women from marginalized racial and ethnic groups, was one of the issues addressed by the Rapporteur. She emphasized that, although abortion is permitted in specific cases such as rape, fetal anencephaly and when the woman\u00b4s life is at risk, many women still face significant barriers to accessing these services. A case in the state of Santa Catarina, where an 11-year-old girl came under pressure to not terminate a pregnancy resulting from rape, was cited as an example of the difficulties faced. Ashwini K.P called on Brazil to decriminalize abortion in all circumstances and ensure safe and legal access to abortion and post-abortion services, emphasizing the need to guarantee women's bodily autonomy.<\/span>\r\n<h2><b>The Timeframe Thesis and territorial rights<\/b><\/h2>\r\n<span style=\"font-weight: 400;\">The Rapporteur also expressed serious concern about the application of the Timeframe Thesis, which limits the recognition of Indigenous lands to those that were under the possession of Indigenous peoples on the date of the promulgation of the 1988 Constitution. According to Ashwini K.P the Thesis ignores the long history of violence and displacement suffered by Indigenous peoples, like the Xokleng in Santa Catarina and poses a threat to territorial rights. She highlighted that, despite some recent progress in land demarcation, the current pace is insufficient, leading to a continued scenario of violence against Indigenous and Quilombola communities.<\/span>\r\n<h2><strong>Use of body cameras and artificial intelligence<\/strong><\/h2>\r\n<span style=\"font-weight: 400;\">Regarding public security, the expert addressed the use of body cameras and facial recognition systems by police forces in Brazil. She praised the Ministry of Justice's initiative to promote the use of body cameras but pointed out that their implementation is still ineffective in many states. Additionally, she expressed concern about the growing use of facial recognition systems, which, in her opinion, can exacerbate racial profiling and violence against Afro-descendants and other marginalized groups. Ashwini K.P called for strict regulation based on human rights principles for the use of these technologies, aiming to protect the rights of the communities that are affected.<\/span>\r\n<h2><b>Urgent actions<\/b><\/h2>\r\n<span style=\"font-weight: 400;\">\u201cThe seriousness of the situation demands the utmost urgency. Bold and transformative actions to dismantle systemic racism cannot wait.\" Said the Rapporteur. According to her assessment, the pace of change does not match the urgency of the situation faced by marginalized racial and ethnic groups in Brazil. She pointed to significant gaps in the implementation and scope of laws and policies and stated that progress on key issues of racial justice has been slow. \u201cPeople from marginalized racial and ethnic groups have already waited too long for justice and equality.\" She said. \"There are lives that depend on bolder and more immediate actions.\"<\/span>\r\n\r\n<span style=\"font-weight: 400;\">According to the Rapporteur, systemic racism has persisted since the formation of the Brazilian state, despite the continuous and courageous advocacy efforts of marginalized ethnic and racial groups. At the review, a form of accountability in the field of human rights that happens every four years, 119 Member States made recommendations to the country based on three documents: what Brazil says about itself; the problems identified by civil society; and the compilation of reports from UN agencies on human rights in Brazil.\r\n\r\nThe document by the Brazilian government explaining the measures that have been taken was prepared by the Ministry of Women, Family and Human Rights. It was released in May 2022 based on the recommendations made in the third cycle. According to analysis by the UPR Group \u2013 made up of 30 Brazilian organizations that are monitoring the review process \u2013 the Brazilian report \u201cis a very long way from reflecting the sad current reality of setbacks and dismantling of human rights that have occurred in the country in recent years\u201d.\r\n\r\nFinally, in November, the UN released the report with the recommendations of the Member States. Conectas has separated the main recommendations:\r\n<h2><strong>Indigenous rights<\/strong><\/h2>\r\nThe need to demarcate indigenous territories, strengthen protection bodies and reject the so-called \u201ctime frame\u201d thesis for indigenous land was brought up by 25 countries. As recommended by Switzerland, Brazil urgently needs to promote 1) \u201cthe constitutional rights of indigenous peoples, resuming, without delay, the process of demarcating their lands, allocating financial and human resources to protect them\u201d, while also noting that it is necessary to \u201cstrengthen key institutions such as Funai (National Indian Foundation)\u201d.&nbsp;\r\n\r\nNorway also reinforced this urgency by recommending that Brazil 2) \u201ccomplete the land demarcation processes, reject the \u2018time frame\u2019 thesis and ensure that indigenous peoples are protected from threats, attacks and forced evictions\u201d and that it should ensure \u201crespect for the right of indigenous peoples to free, prior and informed consent by establishing formal and inclusive procedures\u201d.\r\n<h2><strong>Protection of human rights defenders and journalists&nbsp;<\/strong><\/h2>\r\nAccording to the international NGO Global Witness, Brazil ranks in first place among countries that most kill human rights defenders worldwide, with 342 murders over the past ten years. It is no coincidence that, among the reviewing countries, 16 urged protection for environmental and human rights defenders and journalists in order to enable the work of civil society and guarantee freedom of the press.&nbsp;\r\n\r\n\u201cIn addition to the record number of killings of rights defenders, the federal government has worked actively over the past four years to criminalize the work of civil society and persecute opponents, as well as to resist the demarcation of indigenous lands, to increase gun ownership among the population and to incite attacks on the press,\u201d said Camila Asano, program director at Conectas.\r\n\r\nAmong the recommendations, countries such as Sweden stated that it is necessary to 3) \u201censure that threats and attacks against all human rights defenders are promptly and thoroughly investigated, and that those responsible are held accountable in accordance with due process and the rule of law\u201d.\r\n<h2><strong>Combating racism<\/strong><\/h2>\r\nThe fight against racism and violence against the black population was also one of the main highlights of the document. More than 15 countries asked Brazil to pay more attention to police lethality against black people, enforced disappearances, the combat and prevention of torture and access to justice for the poorest population.\r\n\r\nAs noted by Canada, it is necessary to 4) \u201ctake measures to prevent, investigate and prosecute alleged cases of police abuse, with specific actions to address racism and violence, particularly toward Afro-Brazilians\u201d. The United States also pointed out 6) the need to protect freedom of religion and belief.&nbsp;\r\n\r\nIn reference to several social factors, Argentina recommended that Brazil 5) \u201ccontinue working to adopt the pertinent reforms to have a legal and public policy framework that allows for a more effective fight against racism, discrimination and structural violence against persons of African descent, with an intersectional perspective that includes LGBTIQ+ people and measures to prevent crimes due to prejudice against the trans and transvestite population and travesticides and transfemicides\u201d.\r\n<h2><strong>Sexual and reproductive rights<\/strong><\/h2>\r\nMore than once during the session, the Brazilian delegation reinforced that Brazil believes in life from conception, which contradicts the country\u2019s own legislation that permits abortion in cases of rape, risk of the mother\u2019s death or anencephaly, via a Supreme Court ruling.&nbsp;\r\n\r\nThe inconsistency on the topic was highlighted in the recommendations of the Member States, which called for respect for women\u2019s rights, both in combating gender violence and in full access to sexual and reproductive rights.
