It is the content rating system provided for in the Child and Adolescent Act.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the law, parents are responsible for controlling their children\u2019s access to certain types of content, but it is the job of the Brazilian State, through the Ministry of Justice, to guarantee the necessary means to exercise this control \u2013 which, in practice, means informing the audience about sensitive scenes and adjusting the content to programming times.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2001, the Brazilian Labor Party (PTB) submitted an ADI (Direct Action of Unconstitutionality) to the Supreme Court to undermine the content rating system and overturn the ban on sensitive content at times of greater exposure to children and adolescents. The party argued that the mechanism violates freedom of expression and the free expression of thought.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Conectas, Andi (News Agency for Children\u2019s Rights), Inesc (Institute for Socio-Economic Studies) and the Alana Institute filed a joint amicus curiae brief in the case and defended the importance and constitutionality of the content rating system. In their brief, the organizations told the history of the mechanism and its alignment with the principles of social communication provided for in the Constitution. They also explained the importance of broadcasting in the country, given its enormous presence in Brazilian homes, and its fundamentally public nature \u2013 an aspect that imposes the duty of giving absolute priority to children and the general interest of society.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the organizations, therefore, the attempt to associate the content rating system with a violation of freedom of expression is a distortion and weakens the capacity of the Brazilian State to protect children and adolescents from content that may be harmful to their development.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In her oral statement on behalf of the organizations, the lawyer Elo\u00edsa Machado stressed that the rating system does not constitute a ban on content, not least because it is based on self-classification by broadcasters of their own content. She also rebutted the false dilemma between the content rating system and freedom of expression by showing how the model proposed by the system balances and caters to the constitutional principles of social communication and protection of children and adolescents.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The judgment of the ADI began in November 2011 with the vote of the rapporteur, Justice Dias Toffoli. According to his understanding, the PTB\u2019s request is correct and article 254 of the Child and Adolescent Act is unconstitutional. The justices C\u00e1rmen L\u00facia and Ayres Britto voted in line with the rapporteur. But after an adjournment requested by Justice Joaquim Barbosa, the judgment was not concluded. Currently correctional measures only apply to adolescents between 12 and 18 years of age. Children under 12 are sent to the Tutelary Council.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">ADI (Direct Action of Unconstitutionality)\u00a0<\/span><a href=\"http:\/\/portal.stf.jus.br\/processos\/detalhe.asp?incidente=2282474\"><span style=\"font-weight: 400;\">3446<\/span><\/a><span style=\"font-weight: 400;\">, issued in 2005, questioned the constitutionality of articles 16, items I and 230 of the Child and Adolescent Statute.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Lawyer, Guilherme Amorim, who represented Conectas, Funda\u00e7\u00e3o Abrinq pelos Direitos da Crian\u00e7a and Instituto Pro Bono at the STF trial STF, sees the action to ease the Statute as having the aim of criminalising homeless children and adolescents.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">\u201cThe possibility of arresting children and adolescents would represent not only a restriction of freedom beyond legal reasoning, but also the criminalisation of poverty in contravention of the Federal Constitution, particularly article 5\u00ba.\u201d Amorim stressed in his oral statement.<\/span>\r\n\r\n<span style=\"font-weight: in accordance with the watershed times established by the <a href=\"https:\/\/conectas.org\/en\/actions\/justice\/news\/27624-protection-on-tv\"><u>content rating system<\/u><\/a>, which has been provided for in the Constitution and regulated by the <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/L8069.htm\"><u>Child and Adolescent Act<\/u><\/a> since 2006.\r\n\r\nThe decision means, therefore, that although the stations are still required to display the age classification of their programs, they may be broadcast at any time during the day.\u00a0For most of the court justices present in the judgment of the case, the broadcasting watersheds are illegal because they amount to censorship of television programming.\r\n\r\nIn defense of maintaining the content rating system, Brazilian human rights organizations have said that the case only serves the commercial interests of broadcasters and does not consider the harm likely to be caused by programming aired at inappropriate times.\r\n\r\nIn November 2011, Conectas, the <a href=\"http:\/\/www.andi.org.br\/\"><u>News Agency for Children\u2019s Rights (ANDI)<\/u><\/a>, the <a href=\"http:\/\/www.inesc.org.br\/\"><u>Institute for Socio-Economic Studies (INESC)<\/u><\/a> and the <a href=\"http:\/\/alana.org.br\/\"><u>Alana Institute<\/u><\/a> submitted an <a href=\"https:\/\/conectas.org\/arquivos-site\/Conectas_Amicus_ClassIndicativa.pdf\"><u>amicus curiae<\/u><\/a> to the court in defense of the rating system and the programming principles established in the Constitution.\r\n\r\nAccording to the organizations, the case (Direct Action of Unconstitutionality No. 2404) filed by the Brazilian Labor Party (PTB) and supported by Brazilian Association of Radio and Television Broadcasters (ABERT), contests the Child and Adolescent Act by claiming that broadcasters cannot be punished for not complying with the watersheds established by the rating system.\r\n\r\nIn a <a href=\"http:\/\/intervozes.org.br\/nota-publica-em-defesa-da-classificacao-indicativa-com-vinculacao-horaria-para-tv-aberta\/\"><u>public statement<\/u><\/a> released in December 2014, 75 organizations, among them Conectas, described as \u201cunacceptable\u201d the attempt to overturn the rule that requires television channels and distributors of audiovisual products to assign a rating for each program.\r\n\r\n\u201cThe content rating system seeks to balance the right to freedom of expression with the duty to protect children and adolescents, which does not prevent the broadcasting of any program, while abolishing the system does disrespect the fundamental guarantees of young people,\u201d said Rafael Cust\u00f3dio, coordinator of the Justice program at
