{"id":32600,"date":"2021-07-05T14:56:17","date_gmt":"2021-07-05T14:56:17","guid":{"rendered":"https:\/\/conectas.org\/?post_type=litigiopt&#038;p=32600"},"modified":"2021-07-08T12:39:45","modified_gmt":"2021-07-08T12:39:45","slug":"the-national-security-law-and-the-silencing-of-democracy","status":"publish","type":"litigiopt","link":"https:\/\/conectas.org\/en\/litigiopt\/the-national-security-law-and-the-silencing-of-democracy\/","title":{"rendered":"The National Security Law and the silencing of democracy"},"content":{"rendered":"<div class=\"tts_content_wrapper_1\" ><p><span style=\"font-weight: 400;\">Given the increase in the number of inquiries opened based on the National Security Law, the Federal Public Defender\u2019s Office has filed a collective habeas corpus to the Supreme Court to ensure safe conduct and prevent the coercion of people prosecuted, investigated or threatened for expressing their political opinion or for committing so-called crimes against the honor of the President of the Republic or other federal authorities.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case claims that the National Security Law is being used indiscriminately in Brazil against people who express their critical thinking, in violation of fundamental rights and freedoms. It also argues that only conduct intended to attack the institutionality of the State constitutes a crime against national security.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Conectas, Article 19, the Vladimir&nbsp;Herzog Institute, IDMJR (Right to Memory and Racial Justice Initiative) and GAJOP (Office of Legal Counsel to Grassroots Organizations) submitted a joint request to the court for amicus curiae status in the case. In the document, the organizations present data obtained through a Freedom of Information request on the increase in the number of inquiries based on the National Security Law.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The records show that the average number of people investigated for crimes against national security was 9.3 per year between 2000 and 2017. The organizations understand the importance of revoking the National Security Law but stress the need for a broad and inclusive debate on the crafting of new legislation.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The speaker of the Lower House of Congress, Arthur Lira, has said publicly that he plans to approve fast-track status for the bill in order to speed up the legislative process, skipping the important discussions and assessments that occur in committees.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The letter comes in contrast to the statements made by Arthur Lira. It highlights the moment the country is experiencing, after deaths from the pandemic reached a record of 4,000 per day on April 6, 2020. This is why the letter reinforces the importance of Congress focusing its efforts on combating the pandemic.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The document demands public hearings to guarantee a broad debate with society and a meeting between civil society and the sponsor of the bill, Congresswoman Margarete Coelho.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">\u201cSocial participation and transparency of the legislative process are pillars of democracy. It is also the subject of a citizen\u2019s lawsuit filed by Senator Alessandro Vieira with the Federal Justice System, which was referred to the 2nd Civil Court of the Judiciary Section of the Federal District. All these cases are in progress and awaiting a ruling.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">However, the demand is urgent and speed in the passage of these cases could make all the difference.
