The case dates back to 1996, when then President Fernando Henrique Cardoso, by decree, denounced Convention 158 of the ILO (International Labour Organization), which had been ratified by the country just months earlier. The treaty, which is legally binding, contains rules to protect workers from arbitrary dismissals.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 1997, Contag (National Confederation of Agricultural Workers) and CUT, Brazil\u2019s largest trade union, filed Direct Action of Unconstitutionality No. 1625 in the Supreme Court, arguing that the Executive had violated the Federal Constitution by repealing a treaty without the consent of Congress.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Consequently, besides its importance to the debate on labor rights, <\/span><b>the case could definitively determine what procedure will be adopted in Brazil to denounce (repeal) international treaties<\/b><span style=\"font-weight: 400;\">.<\/span><b>\u00a0<\/b><\/p>\n<p><b>In its memorials and request for admission as amicus curiae, Conectas contended that, in addition to the importance of the content of Convention 158, the ruling on the case will have a direct impact on the internalization of human rights norms<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The organization defended the argument of the petitioners that the Constitution, by stating that it is the duty of Congress to \u201cresolve definitively\u201d on treaties (article 49), refers to both the adoption and the repeal of international commitments and, therefore, that the Presidency cannot withdraw from ILO Convention 158 without the approval of Congress.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The case has been suspended since 2016 due to an adjournment requested by Justice Dias Toffoli. To date, five court justices have voted either partially or completely in favor of the case, on the understanding that the Presidency cannot unilaterally denounce a treaty. Conectas has expressed its concern with regards to resolutions by international mechanisms for the protection of human rights.\r\n\r\nIt its democratisation process, Brazil has become a state party of eight of the nine principal international treaties on human rights in the United Nations, among them the International Covenant on Civil and Political Rights (1992) and the first Optional Protocol (2009). It is a state party to the San Jos\u00e9 Pact, Costa Rica (1992), and has agreed to conform to the jurisdiction of the Inter-American Court of Human Rights since 1998.\r\n\r\nThe upholding of international obligations set out in the international human rights treaties in which Brazil is a party state is expressed in Art. 5, paragraph 2, of the Federal Constitution and in Art. 31 of the Vienna Convention on the Law of Treaties, of which Brazil has been a party state since 2009. The observation and implementation of measures adopted by organs linked to international regimes for the protection of human rights, that Brazil decided, autonomously and democratically, to adhere to, is an inherent consequence of participating in these regimes, whether these resolutions are cautionary or decisive, recommendations or sentences. Exceptions represent a risky precedent of judicial insecurity that could have an impact on a large number of cases, including those that affect the rights of more vulnerable populations.\r\n\r\nFor years, Conectas and other civil society organisations have been denouncing different kinds of violations of human rights in our country, pegged to commitments made by the Brazilian state at the level of the global and regional system of human rights. Indeed, these denouncements have led to international condemnations in cases related to conditions in the penitentiary, socio-educational and mental health systems, rural violence, forced disappearances, slave labour, extrajudicial executions and indigenous people, among many others. At the time, the Soviet Union was perceived as a \u201cmajor threat\u201d by Western countries. The text is contained in the <span style=\"text-decoration: underline; color: #0000ff;\"><a style=\"color: #0000ff; text-decoration: underline;\" href=\"https:\/\/www.camara.leg.br\/proposicoesWeb\/fichadetramitacao?idProposicao=2164132\" target=\"_blank\" rel=\"noopener noreferrer\">PDL (Draft Legislative Decree) 861\/17<\/a><\/span> <strong><em>and proceeds for approval by the Senate.<\/em><\/strong>\r\n\r\nAfter <strong><em>the murder of Joao Alberto, a black man who was beaten to death<\/em><\/strong> by security guards at the Carrefour Supermarket in Porto Alegre (RS), guidelines related to confronting racism gained momentum in Congress, which came under further pressure by civil society to give concrete answers to the problem.\r\n\r\nStructural racism reaps lives, violates rights, deepens inequality in our society with a direct impact on black and poor people. It is urgent that Brazil recognizes the extent of racism and has public policies to deal with this historical problem\u201d says Elisa Araujo, advocacy advisor at Conectas.\r\n\r\n<strong><em>What`s at Stake <\/em><\/strong>\r\n\r\nBrazil as a protagonist has played a key role in the initiative that gave rise to the <strong><em>convention<\/em><\/strong> <strong><em>against<\/em><\/strong> <strong><em>Racism<\/em><\/strong>. In 2005, the Permanent Mission of Brazil in the OAS presented to the General Assembly of the body the project for the creation of a working group for the preparation of the document. The country led the WG, being president of the Collegiate three times.\r\n\r\nThe first proposals were presented in 2011 at the <strong><em>3<sup>rd<\/sup> World Conference against Racism,<\/em><\/strong> Racial Discrimination, Xenophobia and Related intolerances, held in Durban, South Africa.\r\n\r\nIn June 2013, the convention was <strong><em>approved<\/em><\/strong> <strong><em>during<\/em><\/strong> <strong><em>the<\/em><\/strong> <strong><em>43<sup>rd<\/sup><\/em><\/strong> <strong><em>ordinary<\/em><\/strong> <strong><em>session<\/em><\/strong> <strong><em>of<\/em><\/strong> <strong><em>the<\/em><\/strong> <strong><em>OAS<\/em><\/strong> in Antigua, Guatemala. The text of the convention was sent by the Executive Branch to the House in 2016 and the thematic Committees approved it in 2018, in the form of a draft legislative decree.\r\n\r\nThe Convention lists <strong><em>15<\/em><\/strong> <strong><em>situations<\/em><\/strong> <strong><em>that<\/em><\/strong> <strong><em>fall<\/em><\/strong> <strong><em>into<\/em><\/strong> <strong><em>racist<\/em><\/strong> <strong><em>acts<\/em><\/strong> <strong><em>and<\/em><\/strong> <strong><em>manifestations<\/em><\/strong>, such as \u201cany repressive action based on discrimination rather than based on the person`s behavior or objective information that identifies their involvement in criminal activities.\u201d\r\n\r\nThe document states that ratifying countries must also <strong><em>commit<\/em><\/strong> <strong><em>themselves<\/em><\/strong> <strong><em>to<\/em><\/strong> <strong><em>ensuring<\/em><\/strong> <strong><em>that<\/em><\/strong> <strong><em>their<\/em><\/strong> <strong><em>political<\/em><\/strong> <strong><em>and<\/em><\/strong> <strong><em>legal<\/em><\/strong> <strong><em>systems<\/em><\/strong> \u201c<strong><em>adequately<\/em><\/strong> <strong><em>reflect the diversity of their societies <\/em><\/strong>in order to meet the legitimate needs of all sectors of the population, in accordance with the scope of the convention.\u201d\r\n\r\n<strong><em>Convention, Constitution and Law <\/em><\/strong>\r\n\r\nInternational conventions are <strong><em>agreements signed between two or more countries<\/em><\/strong> that can relate from trade issues to combating inequalities and promoting rights.\r\n\r\nAfter being signed by diplomatic representations, these documents need to be ratified by congress, in a vote in both houses, and can be adopted as an amendment to the constitution, when they deal with human rights, or serve as a basis for the drafting of laws.\r\n\r\nA well-known example: after Brazil was condemned at the Inter-American Commission on Human Rights (IACHR) in a case on domestic violence<strong><em>, <span style=\"text-decoration: underline; color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/decreto\/1996\/d1973.htm\" target=\"_blank\" rel=\"noopener noreferrer\">the Inter-American Convention to Prevent, Punish and Eradicate Violence Against Women<\/a><\/span><\/em><\/strong>; also Known as the Belem do Para Convention, served as a pressure for the country to line its Policies to combat Violence against women, leading to the drafting of the famous <strong><em>Maria da Penha Law.<\/em><\/strong>\r\n\r\nThe International Convention on the rights of persons with Disabilities came to be in 2009, it became the first convention on human rights to enter with <strong><em>constitutional<\/em><\/strong> <strong><em>amendment<\/em><\/strong> <strong><em>force<\/em><\/strong> <strong><em>in<\/em><\/strong> <strong><em>Brazil<\/em><\/strong>.\r\n\r\n<strong>Constitution Amendment <\/strong>\r\n\r\nInternational human rights treaties and conventions may be considered equivalent to the constitutional amendment. To do so,<strong><em> they need to be voted in two shifts, with the approval of at least 3\/5 <\/em><\/strong>of the members of the House (308) and the Senate (49).\r\n\r\nThe PDL 861\/17 was approved in the House in the first round by 414 votes to 39 and, in the second round, by 417 votes to 42.
