The federal government, fearing that its provisional executive orders would lose their validity if they were not approved by lawmakers within the specified period of 120 days, asked the Supreme Court to suspend this deadline until the normalization of legislative activities. The ADPF Case (Allegation of Violation of a Fundamental Precept) No. 663 was filed by the Attorney General\u2019s Office in April.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In practice, the <\/span><b>Executive wanted its orders to carry the weight of law for the duration of the State of Public Calamity<\/b><span style=\"font-weight: 400;\"> resulting from the Covid-19 pandemic \u2013 which would give the federal government the green light to legislate through these orders, posing a serious risk to democracy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a swift joint response, the governing boards of the Lower House of Congress and the Senate submitted a joint statement to the Supreme Court with a request for an injunction. In the document, the members of Congress and senators defended an adaptation of the procedure for analyzing provisional executive orders to speed up the process and they rejected the possibility of suspending the approval deadline.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The proposal of Congress was accepted by the rapporteur of the case, Justice Alexandre de Moraes. As a result, instead of being debated by a joint committee, the orders started to be analyzed by one lawmaker from each house and, after the presentation of their report, voted remotely in a full session.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In April, Conectas was admitted as an amicus curiae in the case together with IDDD (Defense of the Right to a Defense Institute), ISA (Socioenvironmental Institute) and the Alana Institute. In their statement to the court, the organizations said that <\/span><b>the provisionally approved text eliminates the already limited room for the participation of civil society in the legislative debate<\/b><span style=\"font-weight: 400;\">. Besides eliminating the analysis by joint committee, it reduces the time limit for submitting amendments from six days to two.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhat can be observed from this procedure is that, because of both the extremely short amount of time allotted for the presentation of amendments and the complete elimination of the Joint Committee stage, the participation and influence of society in the legislative process, both organized civil society and groups affected by the order, has been completely impeded,\u201d they said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the organizations, <\/span><b>the contribution of civil society to the legislative process is essential to guarantee rights<\/b><span style=\"font-weight: 400;\"> and procedural rules should not be used to undermine the constitutional obligation to assure in-depth debate on regulatory acts issued by the Executive, expressed in article 62 of the Federal Constitution.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In December 2020, the full bench of the Supreme Court confirmed the decision of Justice Alexandre de Moraes to reject the suspension of the approval deadline requested by the federal government. On account of the novel coronavirus pandemic, the Bolsonaro government has asked the Supreme Court to consider the suspension of the deadline for the National Congress to vote on these Orders. In practice, this would give the president greater powers to govern and legislate without the participation and control of Congress.\r\n\r\nAccording to the Constitution, a Provisional Executive Order can be issued by the Executive and have immediate legal effect. The text must deal with relevant issues to be applied urgently at the national level. The Congress then has a period of up to 120 days to analyze the measure. If members of Congress do not vote before the end of this deadline, the legislation loses validity.\r\n\r\n<strong>The reaction of Congress<\/strong>\r\n\r\nFollowing the government\u2019s request, the Lower House of Congress and the Senate jointly agreed to a procedure to speed up the approval of the Orders. The procedure skips some stages of the normal passage of the legislation, making the process faster. The new rule excludes the stage of debating the Orders in a Joint Committee of Congress, leaving it up to each house to vote on them separately in a full session.\r\n\r\nThe change will impact the democratic process that underpins the approval of these measures. By eliminating the need for a Joint Committee, the new rule does not provide enough time and space for public hearings and discussions so third sector organizations can offer insights on the legislation. Moreover, passage through a Joint Committee is constitutional (article 62, paragraph 9).\r\n\r\n\u201cBy removing this space for debate with society, Congress is allowing insufficient time and space for studying the issue and for making suggestions to improve the texts,\u201d explained Camila Asano, program coordinator at Conectas.\r\n\r\n\u201cIf this new rule is maintained, it could severely limit the participation of society in the legislative process for the approval of Provisional Executive Orders, by preventing the contribution of experts, academia and groups that defend the populations affected by the measures. Obviously, the work of the Joint Committee should be done remotely, making use of the technology solutions that Congress already uses, and new deadlines can be set exceptionally considering the current state of the pandemic,\u201d she added.\r\n\r\n<strong>Supreme Court<\/strong>\r\n\r\nThere are two legal actions currently pending in the Supreme Court that propose letting the government issue Provisional Executive Orders with the deadlines for approval in Congress suspended while the coronavirus pandemic lasts: one from President Jair Bolsonaro and another from the Progressive Party.\r\n\r\nThe rapporteur of the case, Justice Alexandre de Moraes, stated <span style=\"text-decoration: underline;\"><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.in.gov.br\/web\/dou\/-\/ato-conjunto-das-mesas-da-camara-dos-deputadose-do-senado-federal-n-1-de-2020-250639870\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>in his decision<\/strong><\/a><\/span><\/span> that the suspension of these deadlines is unconstitutional and he emphasized the need for the proper functioning of the democratic institutions. Justice Moraes noted the fundamental importance of letting the Legislature decide on matters legislated by Provisional Executive Order. He therefore authorized the Lower House of Congress and the Senate to speed up the <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/static.poder360.com.br\/2020\/03\/ADPF-663.pdf.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><span style=\"text-decoration: underline;\">procedure for voting<\/span><\/strong><\/a><\/span> on these measures \u2013 considering the urgency currently needed to discuss and solve problems.\r\n\r\nOn Thursday, April 16, the Supreme Court will decide on the injunction granted by Justice Moraes. The reason for the request is the lack of transparency by the federal government in the release of data on the Covid-19 pandemic.\r\n\r\nAccording to the letter, the official website where data on the coronavirus in Brazil is released was offline between June 5 and 6. The electronic address now has a new site that does not report the accumulated number of cases and deaths, nor the infection and death rates per 100,000 inhabitants and lethality.\r\n\r\nThe measure taken by the government of President Jair Bolsonaro also removed historical data on Covid-19 in Brazil from the SUS (public healthcare system) repository. And the Ministry of Health has announced that it will recount the number of deaths, accusing state governments of falsifying data, even though the ministry has not proved this.\r\n\r\nIn the letter, the organizations highlight that the elimination of official information should be viewed with concern \u201cbecause transparency mechanisms are essential in a democratic government to permit public participation and accountability. During the pandemic, opaqueness can cost lives\u201d.\r\n\r\nOn the position of the federal government in relation to Covid-19 data, the organizations condemn what they consider abuse of authority in the attempt to obstruct the right to information.\r\n\r\nThe signatories of the letter are calling for the protection of the country in an appeal for the defense of transparency. The use of the machinery of government to attack the press, however, is nothing new to the Jair Bolsonaro government.\r\n\r\nThe lack of official information on the pandemic is not just an attack on access to information, it also attacks freedom of expression and of the press. These are not isolated cases, but instead they are part of an ongoing and systematic use of the machinery of government to hinder the work of communicators, create a hostile environment for them to practice journalism and, at the same time, reduce transparency in Jair Bolsonaro\u2019s government. Furthermore, the right to knowledge of the entire Brazilian population is violated \u2013 which is particularly serious given the current public health emergency.\r\n\r\nThe federal government\u2019s attempt to control the narrative of the pandemic through opaqueness and sharing information without scientific evidence or being based on reality comes at the cost not only of democracy, but also the lives of thousands of people, especially the most vulnerable.\r\n\r\nThe organizations listed below condemn the abuse of authority by the senior levels of the Brazilian federal government and the attempt to obstruct the right to information and journalism by hiding information of public interest. We appeal to the other branches of government to investigate and punish any acts of administrative misconduct with the utmost rigor. This overall number includes decrees (705), resolutions (65), provisional measures (32) and executive orders (14), among others.<\/span><\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">This is one of the results of the new study conducted by <\/span><a href=\"http:\/\/cepedisa.org.br\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff;\"><strong><span style=\"text-decoration: underline;\">Cepedisa (Center for Studies and Research on Health Law)<\/span><\/strong><\/span><\/a><span style=\"font-weight: 400;\"> of the Faculty of Public Health at USP (University of S\u00e3o Paulo) in partnership with Conectas Human Rights. Based on research in the Federal Gazette and other official publications, the project<\/span><b>\u00a0\u201c<a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2020\/07\/01boletimcovid_PT.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline; color: #0000ff;\">Mapping and analysis of the legal norms for responding to Covid-19 in Brazil<\/span><\/a>\u201d\u00a0<\/b><span style=\"font-weight: 400;\">proposes to <\/span><b>analyze all the legal norms in response to the Covid-19 pandemic in the country<\/b><span style=\"font-weight: 400;\"> on the federal, state and municipal levels, and publish the result in bulletins published every two weeks.<\/span><\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The first issue of the <\/span><b>Rights in the Pandemic Bulletin<\/b><span style=\"font-weight: 400;\">, which covered the period from January 1 to May 31, 2020, notes that the federal government issued <\/span><b>57 provisional measures, of which more than half (32) were norms related to the Covid-19 pandemic<\/b><span style=\"font-weight: 400;\">. This represents four times more than the number of provisional measures issued in the same period last year (14), at the start of the current administration.<\/span><\/span>\r\n\r\n<img class=\"alignnone size-full wp-image-21735\" src=\"https:\/\/conectas.org\/wp-content\/uploads\/2020\/07\/Screen-Shot-2020-07-06-at-19.00.41.png\" alt=\"\" width=\"1398\" height=\"1396\" \/>\r\n\r\n<span style=\"font-weight: 400; color: #000000;\">According to the Cepedisa researcher Fernando Aith, the huge number of norms created by the Executive on Covid-19 has limited the role of the Legislative Branch and hindered the exercise of citizenship.<\/span>\r\n\r\n<span style=\"font-weight: 400; color: #000000;\">\u201cNumerous sub-legal norms overstep the administrative sphere and create obligations for the general population in a fragmented and sometimes contradictory manner,\u201d said Aith. \u201cFurthermore, it promotes the judicialization of health care, since the compliance with the law of the norms issued by the Executive Branch is often challenged in the Judicial Branch,\u201d he added.<\/span>\r\n<h4><span style=\"color: #000000;\"><b>Discrimination against Venezuelans<\/b><\/span><\/h4>\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The Rights in the Pandemic Bulletin draws attention to the <\/span><b>number of norms regulating the movement of people across borders<\/b><span style=\"font-weight: 400;\">. From January to May, there were 15 inter-ministerial decrees, most of them signed by the Office of the Chief of Staff and the ministries of Justice, Health and Infrastructure.<\/span><\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">According to researcher Deisy Ventura, from Cepedisa, many of these decrees <\/span><b>violate Brazilian laws and international treaties ratified by the country<\/b><span style=\"font-weight: 400;\">.<\/span><\/span>\r\n\r\n<span style=\"font-weight: 400; color: #000000;\">\u201cWe recognize the importance of tighter border restrictions as part of the efforts to contain the spread of the disease, but many of the measures adopted are disproportionate,\u201d said Ventura.<\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">On 22 May, the government issued <\/span><a href=\"http:\/\/www.in.gov.br\/en\/web\/dou\/-\/portaria-n-255-de-22-de-maio-de-2020-258114133\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff;\"><strong><span style=\"text-decoration: underline;\">Decree No. 255<\/span><\/strong><\/span><\/a><span style=\"font-weight: 400;\"> that consolidated all restrictions on entry into the country. The decree discriminates specifically against Venezuelan citizens, banning their entry into Brazilian territory even when they have a residence permit or a Brazilian spouse or children.\u00a0Decree No. 255\/19 also <\/span><a href=\"https:\/\/conectas.org\/noticias\/nova-regra-para-fronteiras-restringe-acesso-de-migrantes-em-busca-de-refugio\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><span style=\"text-decoration: underline; color: #0000ff;\">establishes the possibility of summary deportation<\/span><\/strong><\/a><span style=\"font-weight: 400;\">, which is forbidden by Brazilian law that guarantees migrants the right to a fair trial and the principle of due legal process.<\/span><\/span>\r\n\r\n<span style=\"font-weight: 400; color: #000000;\">\u201cMost Venezuelans who come to Brazil do so as refugees, so the decree not only violates the Convention on the Status of Refugees but it also discriminates based on nationality, in violation of international treaties signed by Brazil, such as the aforementioned Convention, as well as the Brazilian Migration Law and the Federal Constitution itself, which establishes the principle of non-discrimination,\u201d she added.<\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Currently, Decree No. 255 has been <\/span><a href=\"https:\/\/conectas.org\/noticias\/nova-regra-para-fronteiras-restringe-acesso-de-migrantes-em-busca-de-refugio\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline; color: #0000ff;\"><b>replaced by No. 340<\/b><\/span><\/a><span style=\"font-weight: 400;\">, which maintains the same problems identified in the previous decree.<\/span><\/span>\r\n<h4><span style=\"color: #000000;\"><b>About the Rights in the Pandemic Bulletin<\/b><\/span><\/h4>\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Given the urgency that the Covid-19 pandemic has created in Brazil and around the world, the Rights in the Pandemic Bulletin proposes to conduct <\/span><b>comprehensive research into all the legal and sub-legal norms<\/b><span style=\"font-weight: 400;\"> issued by government in Brazil, whether on the federal, state or municipal level.<\/span><\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The project is being conducted by a multidisciplinary team and consists of documentary research to <\/span><b>establish a database of norms, with the production of data for qualitative analysis of the potential impact on human rights<\/b><span style=\"font-weight: 400;\">, as well as the production of data for disaggregation and quantitative analysis, in particular cross-referencing data on the norms with epidemiological indicators.<\/span><\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The project proposes to <\/span><b>analyze<\/b> <b>the impact of the new legislation on fundamental rights<\/b><span style=\"font-weight: 400;\">, so that it will be possible to monitor its effects in the medium and long term.<\/span><\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The publication released today also addresses questions about <\/span><b>what a pandemic is and how a disease is named, and it compiles the 85 recommendations of the IACHR<\/b><span style=\"font-weight: 400;\"> (Inter-American Commission on Human Rights) on how States should respond to the pandemic without violating rights.<\/span><\/span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\"><a href=\"https:\/\/conectas.org\/wp-content\/uploads\/2020\/07\/01boletimcovid_PT.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;
