Photo: Marcelo Camargo\/Ag\u00eancia Brasil<\/p><\/div>\n<p><span style=\"font-weight: 400;\">In late April 2020, in the middle of the Covid-19 pandemic, more than a hundred migrants, most from Venezuela, were forcibly removed from an area of the city of Boa Vista known as Clamor do Rio. Among them were dozens of children, pregnant women, adolescents and elderly people.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The operation, led by the Municipal Environment Department, was conducted without a court order and without any prior notice to the families. Furthermore: it did not provide any assistance to the evicted people, who suddenly found themselves with nowhere to sleep or anything to eat.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To guarantee immediate support for the families and request a ban on further such evictions, Conectas, the Federal Public Defender\u2019s Office, the CMDH (Center for Migration and Human Rights) and the Jesuit Service for Migrants and Refugees filed a Public Civil Action with the federal justice system in the state of Roraima.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the request for urgency, the organizations called for financial, food, medical and housing assistance for the people removed from Clamor do Rio. They also requested a ban on all forced removals and land repossessions during the pandemic.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the organizations, <\/span><b>the operation was completely illegal and violated the fundamental rights of the affected people. Besides the absence of a court order and a reasonable justification, which in itself is serious, the eviction occurred without observing the most basic principles of human rights<\/b><span style=\"font-weight: 400;\">: the families were not notified in advance; there was no plan to relocate the people to shelters (even temporarily); and no medical, health or food support was offered \u2013 not even to the most vulnerable people, such as children, adolescents and the elderly.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The petitioning organizations also said the operation violated the Migration Law, the Brazilian Constitution and international standards, rulings and recommendations of the Inter-American Commission on Human Rights and the United Nations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Public Civil Action was received by the on-duty judge, who requested explanations from the Boa Vista municipal government, the federal government and the state government of Roraima. Upon assuming the case, the chief judge of the court denied the injunction request and also excluded Conectas, CMDH and the Jesuit Service for Migrants and Refugees from the case.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The organizations appealed this decision, but the case has not yet been judged by a full session of the appeals court. The original case, which proceeded with the Public Defender\u2019s Office as the sole plaintiff, was dismissed by the judge. Among the adults, there were people who fall into the risk group for Covid-19, such as asthmatics, people with respiratory problems and the physically and mentally disabled.\r\n\r\n<span style=\"text-decoration: underline;\"><a href=\"http:\/\/g1.globo.com\/rr\/roraima\/jornal-de-roraima\/videos\/t\/edicoes\/v\/guarda-municipal-retira-30-familias-de-imigrantes-de-ocupacao-as-margens-do-rio-branco\/8515992\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><span style=\"color: #0000ff; text-decoration: underline;\">A story run by the television channel G1 Roraima<\/span><\/strong><\/a><\/span>\u00a0shows the us<span style=\"text-decoration: underline;\">e<\/span> of a backhoe by the police to demolish the makeshift accommodation at the occupation known as \u201cClamor do Rio\u201d and informs that the justification given by the municipal government was to prevent gatherings of people in this environmental area.\r\n\r\nThe organizations, however, draw attention to the lack of legal authorization for the measure and to the fact that the removal took place in the midst of a public health emergency caused by the novel coronavirus pandemic. In February this year, municipal law 2,074\/2020, which established the discriminatory rule on treatment for Venezuelans in public hospitals and health clinics in the city, was <strong>challenged in a public civil action<\/strong> filed by the Federal Public Defender\u2019s Office in partnership with Conectas Human Rights.\r\n\r\nThe lawsuit asked the court to lift the restriction on health care for Venezuelans under penalty of daily fines of R$100,000. After the request for an injunction was denied by the 4th Federal Court, the organizations appealed to the TRF-1, which fully accepted the request and ordered the Municipality of Boa Vista to stop any discrimination based on nationality that restricts health care for migrants. Having fled their countries due to political persecution, risk of death or serious and widespread human rights violations, these people are struggling to guarantee their rights and remake their lives.\r\n\r\nIn the week when Global Refugee Day is celebrated, on June 20, Conectas spoke to the president of the CNDH (National Human Rights Council), the federal public defender Renan Sotto Mayor, about the situation facing migrants and refugees in the context of the novel coronavirus pandemic.\r\n\r\nRenan has a masters in Sociology and Law from the Fluminense Federal University and he is currently the secretary-general of liaison at the Federal Public Defender\u2019s Office.\r\n\r\n<strong>Conectas \u2013 What are the main problems faced by migrants and refugees in the Covid-19 pandemic?<\/strong>\r\n\r\nRenan Sotto Mayor \u2013 The pandemic has exposed the structural inequalities in our country affecting several extremely vulnerable groups. The situation facing migrants, refugees and asylum seekers, which was already one of vulnerability, has deteriorated further. Apart from the matter of the recent inter-ministerial orders that permit\r\ndeportation and the suspension of asylum, the borders have also been closed, causing incalculable damage to these people. Another very serious issue is the difficulty accessing emergency assistance. Although this assistance was created to ensure a minimum subsistence income for people in need, migrants unfortunately have generally\r\nencountered difficulties accessing this benefit. We\u2019re now in June and the Brazilian State has not yet resolved the bureaucratic obstacles so these people can have their rights respected. The situation facing Venezuelan migrants and asylum seekers is also dramatic. Things were already bad before the \u201ccoronacrisis\u201d and now it\u2019s even worse.\r\n\r\n<strong>The Brazilian government ordered the closure of its borders as a health measure to combat the pandemic. What migrant and refugee rights could be threatened by this measure?<\/strong>\r\n\r\nSeveral constitutional rights and also those protected by human rights treaties have been directly violated. For example, the fundamental right to equal treatment for nationals and non-nationals before the law, provided for in article 5 of the Constitution, and the right to universal access to health established in article 19, sole paragraph,\r\nitem I. Additionally, as we noted in <a href=\"https:\/\/www.gov.br\/mdh\/pt-br\/acesso-a-informacao\/participacao-social\/conselho-nacional-de-direitos-humanos-cndh\/RESOLUON19DE06DEMAIODE2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><span style=\"text-decoration: underline;\"><span style=\"color: #0000ff; text-decoration: underline;\">CNDH Recommendation No 19 of May 6, 2020<\/span><\/span><\/strong><\/a>, the suspension of requests for asylum violates the international law principle of non-refoulement, contained in article 33, item 1, of the 1951 Convention on the Status of Refugees, and also in article 22, item 8, of the American Convention on Human Rights\r\nand article 7, paragraph 1, of Law 9,474\/1997, according to which nobody may be deported to the frontiers of territories where their life or freedom would be threatened. It\u2019s also important to highlight that article 31 of the 1951 Convention and article 8 of Law No. 9,474\/1997 do not permit the suspension of asylum requests as punishment for irregular entry into Brazilian territory.\r\n\r\n<strong>According to the NGO Compassiva, there are currently at least 400 foreign doctors who are unable to work in Brazil because examinations to recognize foreign medical diplomas have not been held for three years. In the meantime,<\/strong><strong>there are not enough doctors available to open field hospitals like the one in Boa Vista. What do you think about relaxing the hiring rules for these doctors during the pandemic, like Germany, the United States and Canada have done?<\/strong>\r\n\r\nThis relaxing of rules would be temporary and as an emergency. I fully support this and I believe it would be fundamental to guarantee the right to health of people in situations of extreme vulnerability. We have noticed a serious lack of doctors in Brazil, mainly in the Northern region. This is a structural problem that needs be addressed broadly, pursuing definitive solutions. However, this inaction by the Brazilian State cannot continue any longer, especially during a pandemic. As such, I think the temporary and emergency measure to relax the rules for recognizing foreign medical diplomas is important for millions of people in Brazil to have effective access to the fundamental\u00a0right to health.\r\n\r\n<strong>Have migrants been able to receive the emergency assistance provided by the government during the pandemic and how important is this assistance for these people?<\/strong>\r\n\r\nMigrants who meet the legal requirements are entitled to the emergency assistance. This assistance is a minimum subsistence income, which is why it is so essential for people to receive this benefit. Unfortunately, we have seen that the program was set up ignoring the situation of people who are truly hyper-vulnerable, such as people living on\r\nthe streets and various other groups that do not have access to a mobile phone to request the benefit. Similarly, the program was clearly set up for Brazilian nationals and did not take into account the specific situation of migrants, in particular with regard to documentation. The Federal Public Defender\u2019s Office in S\u00e3o Paulo, observing this\r\nsituation, filed a public civil action against the [state-owned bank] Caixa Econ\u00f4mica Federal and the Central Bank of Brazil requesting emergency relief so that migrants, regardless of their immigration status, can receive the emergency assistance by presenting any identity document, even if it has expired. To date, unfortunately, no\r\ncourt ruling has been given in this public civil action.\r\n\r\n<strong>In late April, the municipality of Boa Vista removed more than 100 migrants from an occupation known as \u201cClamor do Rio\u201d without a court order or prior eviction notice. The operation was carried out during the pandemic and did not even take the families to a new shelter. Can governments take this type of action in a health emergency like the one we are experiencing? What measures should be adopted to guarantee the rights and security of these families?<\/strong>\r\n\r\nThis type of action is incompatible with the constitutional rule of law. First, it is important to emphasize that the right to adequate housing should be guaranteed for all people. However, unfortunately this is not a reality for many people who live in Brazil. Considering the lack of an effective public housing policy, the federal government, the\r\nState of Roraima and the Municipality of Boa Vista should try to guarantee the right to housing for these people. Seeing this situation, the Federal Public Defender\u2019s Office, in partnership with Conectas, the Center for Migration and Human Rights and the Jesuit Service for Migrants and Refugees filed a<a href=\"https:\/\/conectas.org\/noticias\/defensoria-e-organizacoes-entram-com-acao-na-justica-contra-remocao-ilegal-de-venezuelanos-em-boa-vista\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><span style=\"color: #0000ff; text-decoration: underline;\"><strong> public civil action requesting interimrelief<\/strong><\/span><\/span><\/a>, stressing the need to receive these people in appropriate shelters. Unfortunately, the case was rejected. Everyone who works with human rights experiences this discrepancy between what should be and reality. What happened was a clearly misguided and unlawful action by the municipal government of Boa Vista. This is why the National Human Rights Council issued Resolution <a href=\"https:\/\/www.gov.br\/mdh\/pt-br\/acesso-a-informacao\/participacao-social\/conselho-nacional-de-direitos-humanos-cndh\/Resoluon10SoluoGarantidorasdeconflitosfundirioscoletivosrurais.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\"><strong><span style=\"color: #0000ff; text-decoration: underline;\">No. 10 of 2018<\/span><\/strong><\/span><\/a>, which provides solutions guaranteeing human rights and preventive measures for collective and urban land conflicts.
