Photo: Bruno Kelly\/Amazonia Real<\/p>\n<p><\/p><\/div>\n<p><span style=\"font-weight: 400;\">In 2019, Brazil made headlines around the world on account of the environmental devastation caused by forest fires and their incalculable impact on global efforts to combat climate change. In the same year, the Ministry of the Environment, led by Ricardo Salles, changed the composition of the steering committee of the National Fund on Climate Change, better known as the Climate Fund, which has existed since 2009 and is the country\u2019s main body in combating global warming.<\/span><\/p>\n<p><b>The measure limited the participation of the scientific community and civil society in the body and resulted in the suspension of its activities. <\/b><span style=\"font-weight: 400;\">The federal government also blocked funding for projects and failed to allocate most of its budget, which comes from oil royalties and special interest loans granted by BNDES (Brazilian Development Bank).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The maneuver was challenged by opposition parties in the Supreme Court in a Direct Action of Unconstitutionality by Omission (no. 60), although the rapporteur of the case, Justice Lu\u00eds Roberto Barroso, determined that it should be received as an ADPF (Allegation of Violation of a Fundamental Precept, given the number 708).\u00a0<\/span><\/p>\n<p><b>Barroso also noted the importance of investigating an \u201cunconstitutional state of affairs in environmental and climate matters\u201d, which paved the way for a new debate in the court on the State\u2019s responsibility to guarantee climate security for present and future generations.\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">At a public hearing held in September 2020, the coordinator of the Development and Socioenvironmental Rights program at Conectas, Julia Neiva, expressed the importance of a broader interpretation of article 225 of the Federal Constitution, which protects the right to a climatically stable environment.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She also pointed out that climate security is a duty of the State that is closely related to human rights, since it not only affects the rights to health, food, water, culture, development and adequate housing, but it threatens the very survival of people and their right to life and physical integrity.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Using examples, Neiva noted that this interdependence between climate and fundamental guarantees has been recognized by courts around the world and she highlighted that violations related to the climate emergency affect poor, non-white women more harshly, since they live under oppression and marginalization on account of their gender, race, class and territoriality.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finally, Neiva reminded the hearing that the Paris Agreement, which is legally binding, requires States to respect, promote and consider their human rights obligations (including the right to development) when adopting measures to combat the climate emergency.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition to participating in the public hearing, Conectas submitted an application for admission as amicus curiae in the case with the support of the Global Justice Clinic of the NYU School of Law. In the application, the organization said that the suspension of the Climate Fund and the reduction of the budget for controlling deforestation and promoting sustainable production is illegal, undermines the Federative Pact and violates the constitutional right to an ecologically balanced environment. In that year, the program had a budget of R$8 million available for the development of research and projects. At the end of the year, however, only R$718,000 had been committed.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">This year, after the lawsuit was filed in the Supreme Court and the announcement of the public hearing, the steering committee of the Fund, which had been dissolved and replaced under the administration of Minister Salles, was convened again and the ministry hurriedly unlocked funding of nearly <\/span><b>R$530 million that had been stalled for a year and a half<\/b><span style=\"font-weight: 400;\"> awaiting definitions from the minister.<\/span>\r\n\r\n<iframe src=\"https:\/\/www.youtube.com\/embed\/H5BrF-e-1yY\" width=\"680\" height=\"500\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe>\r\n<b>UN General Assembly<\/b>\r\n\r\n<span style=\"font-weight: 400;\">The debate is also occurring ahead of the speech by <\/span><b>Bolsonaro in the UN General Assembly<\/b><span style=\"font-weight: 400;\">, on Tuesday, September 22. The expectation is that the increased fires, deforestation and violence against indigenous peoples in Brazil will be toned down in his speech before the international community.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Recently, on a visit to the state of Para\u00edba, Bolsonaro said that <\/span><b>Brazil is to be congratulated for its environmental protection<\/b><span style=\"font-weight: 400;\">.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">According to data from the INPE, in the first 14 days of September there were <\/span><b>more fires in the Amazon that in the whole of the month last year<\/b><span style=\"font-weight: 400;\">. The rates of deforestation in the Brazilian Amazon have recently reached historical numbers, resulting in a 34% increase from 2018 to 2019.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The coalition is formed by Artigo 19, Articula\u00e7\u00e3o dos Povos Ind\u00edgenas do Brasil (Apib), Conectas Direitos Humanos, Conselho Nacional das Popula\u00e7\u00f5es Extrativistas (CNS), Engajamundo, Greenpeace Brazil, Instituto Alana, Instituto Socioambiental (ISA), Observat\u00f3rio do Clima and Associa\u00e7\u00e3o Alternativa Terrazul.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The NGOs led the development of the lawsuit, which will be formally presented by seven political parties as plaintiffs, because of the procedural requirements of the Action Against the Violation of a Fundamental Constitutional Right (or ADPF for its acronym in Portuguese). The members of the coalition will participate in the proceedings as <\/span><i><span style=\"font-weight: 400;\">amici curiae<\/span><\/i><span style=\"font-weight: 400;\">, or friends of the court.\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">\u201cThe coalition is simply demanding that the Brazilian government complies with the Constitution, which protects present and future generations as well as the Amazon. Even under a totally unambitious contribution to the international Paris Agreement, Brazil is now lacking public policy, budget and staffing to guarantee the application of our national laws. Every human right is impacted by environmental devastation, it is up to our Supreme Court to determine the application of the public policy in force, which has already proved successful when effectively applied\u201d, said Mauricio Guetta, legal adviser at Instituto Socioambiental and legal coordinator of the initiative.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In 2019, the Brazilian government abandoned the most important plan to combat and prevent deforestation in the Amazon forest, the Action Plan for Prevention and Control of the Legal Amazon Deforestation (PPCDAm), going against its own international commitments to reduce greenhouse gas emissions. <\/span><span style=\"font-weight: 400;\">\r\n<\/span><span style=\"font-weight: 400;\">\r\n<\/span><span style=\"font-weight: 400;\">The document submitted to the Supreme Court requires that deforestation be reduced to a rate of 3,925 km\u00b2 by 2021, which should have already happened in 2020, according to the National Policy on Climate Change. This goal would mean a reduction of 60% in relation to the official deforestation rate for 2019-2018. The plaintiffs are calling for a moratorium on deforestation in the Amazon for a year, among other measures, if this objective is not achieved. <\/span><span style=\"font-weight: 400;\">\r\n<\/span><span style=\"font-weight: 400;\">\r\n<\/span><span style=\"font-weight: 400;\">The document also highlights how the shortcomings of the governmental obligation to protect the environment harms the rights of Indigenous Peoples and traditional communities, as well as the fundamental rights of present and future generations in Brazil.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Climate litigation is increasingly gaining traction across the world, with more than 600 legal cases filed by individuals and non-governmental organisations that assert the rights of people impacted by the climate crisis on record[4]. The Brazilian case comes as Norway\u2019s Supreme Court completed hearings today on a lawsuit that calls on the Norwegian government to stop offshore oil licenses under both the national constitution and the Paris Agreement. The meeting will be attended by Mr Luciano Coutinho, President of the BNDES from May 2007 to May 2016 and Mr Arthur Koblitz, President of the BNDES Employees Association.<\/span><\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">According to the organisations, in recent decades, the National Development Bank has been adopting a<\/span><b> pattern of investment that reinforces social inequality, <\/b><span style=\"font-weight: 400;\">violates the rights of communities and exploits ecosystems in an unsustainable fashion, as seen in the loans granted for works at Hydroelectric Plants in Amazonia.<\/span><\/span>\r\n\r\n<span style=\"font-weight: 400; color: #000000;\">\u201cIn the pandemic, the country is seeing federal government\u00b4s inability to handle the public health crisis, states and municipalities going deeper into debt and public policies being undermined through lack of resources (...). This deficit calls for a state bank that is up to the huge task of changing the development paradigm itself and overcoming outdated models of economic growth that ignore social and environmental impacts, which particularly affect the most vulnerable groups of people.\u201d Says the open letter.<\/span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The document goes on to say that the current scenario is an opportunity to do things differently. \u201cMillions of people are being thrown into poverty and extreme poverty and black people are proportionately more affected. Hundreds of businesses, that are the only source of a family\u00b4s income, are disappearing, along with thousands of occupations and jobs.\u201d Finally, it concludes that, it is now fundamental for the BNDES<\/span><b> to promote true social development<\/b><span style=\"font-weight: 400;\">.<\/span><\/span>\r\n\r\n<span style=\"font-weight: 400; color: #000000;\">\u201cThere is a rich local, community-based economy, with a strong characteristic of identity and creativity. It is feminist, indigenous, black, young and from the periphery.
